Puzzitiello, Jr. ("Hennie <br />Homes") from Denial of a Building Permit - <br />Corner of Lorain Road and S.R. 252 - Proposal <br />to Construct a Retail Building - Statement in <br />Support of the Appeal <br />Gentlemen: <br />Please consider this letter as a Statement in Support of <br />the Appeal of my client, Rocco H. Puzzitiello, Jr. ("Hennie <br />Homes") owner of the above parcel of land. <br />Hennie Homes applied for a building permit for a retail <br />building on the parcel of land owned by Mr. Puzzitiello fronting <br />on a corner parcel at Lorain Road and relocated S.R. 252. <br />Relocated S.R. 252 would be the northern extension of Great <br />Northern Boulevard, and has not been constructed. The building <br />would have a Lorain Road address. <br />The Planning Commission denied approval of the plans and <br />issuance of a building permit for the building based on their <br />adoption of an interpretation of Codified Ordinance Section <br />1174.03, regarding the sideline setback for the building along <br />future S.R. 252. The Planning Commission applied a fifty (50) <br />foot setback along the sideline of the parcel along S.R. 252, <br />which prevents any building from being constructed on the <br />owner's property. <br />The building is set back twenty-eight (28) feet from the <br />sideline. If the setback is twenty-five (25) feet, then the <br />proposed building complies. If the setback line is fifty (50)
