Violation of Ord. 62-33, Section 1163.01. <br />Chairman Remmel called all interested parties before the board. The oath <br />was administered to Mr. Moyer and Mrs. Jack, who represented 'the contractor. <br />Chairman Remmel believes that enclosure is too deep and suggested that it <br />be changed to 16' across the rear of the house. Position of the air con- <br />ditioner makes this impossible. Lot to the rear is quite deep. If size of <br />enclosure is reduced they would have to cut existing slab, they now plan <br />to install footers around the outside of existing patio slab. E. Graves <br />moved to grant the 7.33' rear yard variance for the patio enclosure, secon- <br />ded by J. Helon. Roll call on motion: Graves, Helon, Bugala, Aye. Remmel, <br />Nay. Motion passed. Variance granted. <br />5. John E. Brewer, 4320 Bentley Dr. <br />Request for variance (1133.13). Request 5' rear yard variance for addition. <br />Violation of Ord. 62-33, Section 1163.01. Also request special permit for <br />non-conforming dwelling (front set back). Special permission required Ord. <br />62-33, Section 1231.02. <br />Chairman Remmel called all interested parties before the board. The oath <br />was administered to Mrs. Brewer and Mr. Paulker; the contractor. There is <br />an enclosed patio on adjacent lot on one.side of the property, and an ad- <br />dition on the other side. C. Remmel moved to grant the variance and the <br />special permit, seconded by E. Graves, and unanimously approved. Variance <br />and special permit granted. <br />6. George and Linda Shumay, 5820 Barton Road <br />Request for variance (1133.13). Request 1' height variance for fence. Vio- <br />lation of Ord. 62-33, Section 1151.04-H. Also on corner side of property <br />request variance for solid fence, not 3' from property line. Violation of <br />Ord. 62-33, Section 1151.04H-2. <br />Chairman Remmel called all interested parties before the board. The oath <br />was administered to Mr. and Mrs. Shumay who explained that soccer field is <br />behind their property and they want some privacy in their rear yard. They <br />are requesting a 6' fence on the rear property line, but stated that the <br />portion of the fence on the Bradley Road side (corner) is not to be placed <br />on the property line (as indicated on site plan),,it will be inside their <br />property to approximately where the soccer field fence ends. The board <br />agreed that the 6' fence on the south property line should not extend to <br />the front building line, but is willing to accept a 6' fence to the east <br />end of the patio to give them more privacy.. R. Bugala moved that the 1' <br />height variance be provided for a solid fence that extends on the back west <br />property line, no further north than the exisitng 4' chain link fence and <br />that the 6' solid fence on the south side of the property extend no further
