, <br />. <br />: <br />CITY OF NORTH OLMSTED <br />BOARD OF ZONING APPEALS <br />MINiJTES - APRIL 3, 1985 <br />Chairman Remmel called the meeting to order at 7:35 p.m. <br />Present: R. Bugala, R. Gomersall, E. Graves and C. Remmel <br />Also Present: Law Director M. Gareau, Building Commissioner E. Gundy, <br />Recording Secretary B. Oring. <br />R. Bugala moved to:accept the Minutes of March 6, 1985 as written, <br />seconded by E. Graves, and unanimously approved. <br />1. Mike Mohacsek, 26640 Fairfax Lane <br />Itequest_for variance (1133.13). Request 2'6" rear yard variance for patio <br />enclosure. Violation of Ord. 62-33, Section 1163.01. <br />Chairman Remmel-called all interested parties before_the Board. TYie oath <br />was administered to Mr. and Mrs. M. Mohacsek and Mrs. Al1en, a neighbor. <br />Mrs. Allen has no objection. Contractor put footers and slab in without <br />a permit. Slab encroaches into -rear:set back. Chairman Remmel requested <br />that the Building Commissioner check construction of this job carefully. <br />E. Graves moved to grant the rear yard variance, seconded by R. Gomersall, <br />and unanimously approved. Variance granted. <br />2. John M. Simme, 28156 Gardenia Dr. <br />Request for variance (1133.13). Request 16' rear yard variance to install <br />awning. Violation of Ord. 62-33, Section 1163.01. Also request special <br />permit to add to non-conforming dw.elling (front set back). Special per- <br />mission required Ord. 62-33, Section 1231.02. <br />Chairman Remmel called all interested parties before the Board. The oath <br />was administered to Mr. Simme. Chairman Remmel noted that this is an odd <br />shaped lot and awning will not interfere w'ith neighbors view. Mr. Simme <br />stated that this would just be.an awning this year but eventually he <br />would like to screen it in. R. Bugala moved to grant the 16' rear yard <br />variance as long as structure remains, as a screened-in porch (that would <br />be non-living space) and also to grant the special permit, seconded by <br />E. Graves, and unanimously approved. Variance and special permit granted. <br />3. Ma.thew Mathews, 4403 Selhurst <br />Request for variance (1133.13). Request 2' variance for distance between <br />enclosed patio addition and detached garage. Violation of Ord. 62-33, <br />Section 1151.04-C. <br />Chairman Remmel called all interested parties before the Board. The oath <br />was administered to Mr. Kuenn, Patio Enclosures, who explained that the <br />homeowner put in the slab and footers without knowing that a variance <br />would,be needed. E. Graves moved to grant the 2' variance for Mr. Mathews, <br />seconded by E. Graves, and unanimously approved. Variance granted.
