Property is less than 500' from St. Richard's church <br />and school and is intersected by two 50' s.treets. Assistant Law Dir- <br />ector Dubelko stated that, in his opinion, the code is clear and a <br />car wash would not be permitted, but that a variance could be re7 <br />quested. Mr. Frost was aware of the section, but did not think, <br />that it would apply because of the two 50' wide intersecting streets. <br />Mr. Klimco, a member of St. Richards Parish Council, read a'letter <br />priviously submitted to the Board of Zoning Appeals objecting.to the <br />proposal on the basis of traffic congestion, danger to school children <br />and the intrusion into a residential neighborhood. Mrs. N. Mantle <br />of 26989 Whitethorn Ave presented a petition with 93 signatures <br />also objecting to the proposal. Mrs. Mantle also questioned zoning <br />of the lots (front portion is General Retail and rear is residential) <br />and stated that she had been told that there was a ruling.that the <br />lots were General Retail and would like this clarified. She also <br />questioned that since the lots are now being used for parking for the <br />adjacent businesses, what the parking requirements.are.for that strip <br />of businesses. Councilwoman Sarringer and many neighbors voiced <br />objections and urged the Commission to deny the assembly of the pro- <br />perty because of the hazardous condition a car wash would create. <br />Mr. Gorris questioned the legality of combining two non-conforming <br />lot to make one non-conforming lot especially when the zoning is <br />split. Assistant Law Director Dubelko stated that on that simple <br />issue the Planning Commission would be required to combine the lots <br />but only the portion that is General Retail could be used as commer- <br />cial property. Commission would like the Building Department to <br />determine what the parking requirements are for the strip center on <br />Lorain Road and if this parking lot is necessary for their parking <br />and would like the Engineering Department tb show where the zone• <br />line is on the plat map of the two parcels. T. Morgan moved to <br />table the proposed combination of parcels 235-1-12 and 235-1-13 and <br />request that the Building Department review the parking for all the <br />businesses located on this property to see if,. in fact, the parking <br />required by ordinance includes this property diid also that the Engi- <br />neering Department provide on the platting map the zone line between <br />General Retail and Residential so that Planning Commission can re- <br />view that, seconded by E. Traczyk, and unanimously approved. <br />V. COMMUNICATIONS: <br />Ord. 85-7: Assistant Law Director Dubelko explained that he had <br />taken Planning Commissions objections back to the Law Director and <br />they they had rewritten the section to give Planning Commission the <br />power to determine if the proposed used has been integrated.:into the <br />plan in such a manner as will promote the intent and purposes of a <br />mixed use development. T. Morgan moved to approve Ord. 85-7 as <br />amended, seconded by J. Wixted, and unanimously approved. <br />VI. NEW BUSINESS: <br />No items.
