<br />BOARD OF BUILDING CODE APPEALS NOVEMBER 21, 1985 PAGE 2 <br />has been authorized by the F.C.C. Mr. Schulz suggested that the dish be <br />installed in the window. This would not demonstrate how it would look in <br />the yard nor would it be capable of receiving all channels. Mr. Puzzitiello <br />questioned if the intent of the code was for both residential and commer- <br />cial installations. The ordinances covers both. He has no problem with <br />the installation as long as the residential neighbors to the rear are not <br />opposed to it. Mr. Kazak does not believe that setting a precedant should <br />be a problem since the Board decides on each case individually. Mr. Schulz <br />sti11 has concerns and would like the ordinance followed. Councilman <br />Tallon questioned if all the legalities of the dishes have been determined. <br />At present the dishes are legal and Mr. Shumbach assured the Board that if <br />the dish became illegal or outlawed they would remove it. R. Puzzitiello <br />moved to grant the variance with the condition that the fence is put up <br />and in the case that the laws are changed or a court decision changes and <br />the dish has to be discontinued, it has to come down immediately, seconded <br />by J. Kazak. Roll call on motion: Puzzitiello and Kazak, Aye. Schulz, <br />Nay. Chairman Kazak stated that the motion is carried. <br />IV. NEW BUSINESS: <br />1) Corporate Center Office Building (Biskind Development Co), 25000 <br />Country C1ub Blvd. - <br />Request permission to install satellite dish earth station on roof of <br />Cox-porate Center. Violation of Ord. 83-154, Section 1367.04-B, <br />Chairman Kazak administered the oath to Mr. Carlisle, Biskind Development <br />Co, who introduced D. Skrelunas, Chevrolet Motors, who was sworn in at <br />that time. Tfiey explained that the 6r diameter fixed (aimed at one <br />satellite) dish was for Cheyrolet Motors tele-communications s_ystem and <br />would be installed behind the mechanical system`s'_penthouse on the roof of <br />the Corporate Center where it would not be visible from the ground. It is <br />their assumption that since this is the technology of the future, that <br />other dishes would eventually be needed; and they are considering install- <br />ing all of them on the roof of one of the proposed parking garages and <br />screening them a11 from view. This dish will be about 550 feet away from <br />the nearest neighbors, the Westbury Apartments, and will extend over the <br />roof line by approximately 4 feet. Mr. Landsiman, representing the Westbury <br />was sworn in at this time. He objected to the proposal on the basis that <br />this installation would be visible from the upper windows of the Westbury. <br />He reminded the Board that Mr. Richalnd, who was then representing Biskind <br />Development Co., had objected to their request for a 16' high earth station <br />and that the variance had been denied. He is concerned that there will <br />a"garden of dishes" on the roofs of the Corporate Center buildings. Mr. <br />Carlisle responded that if the earth station is located according to the <br />ordinance it will be more visible and he doubts that it will be visible <br />from the Westbury at the proposed location. Mr. Schulz read the minutes of <br />October 25, 1.984 wherein Mr. G. Richland of Biskind Development Co. ob- <br />jected to the Westburys request for a variance on the basis it would be <br />visible from the Corporate Center and would adversly effect their complex. <br />Mr. Carlisle stated that they would not have objected to a roof top instal- <br />14t?on•4nd thi?s installati.on wzll not be visible from the Westbury.
