.1 <br />dl? <br />BOARD OF ZONING APPEALS DECEMBER 5, 1984 PAGE 4 <br />seconded by E. Graves, and unanimously approved. Special permit granted. <br />7. Rober W. Messenger, 28036 Wisteria <br />Request for variance (1133.13). Request 1' height variance for fence (dog <br />pen -- already installed.) Violation of.Ord. 62-33, Section 1151.04-H. <br />Chairman Remmel called all interested parties before the Board. The oath <br />was administered to Mr. and Mrs. Messenger. Dog pen is two lengths of <br />6' fence, and Mr. Messenger stated that dogs behind him can get over a <br />5' fence into his dog pen. He has told the neighbor who complained that <br />they will keep the dog.in the garage at night. A letter from Hyatt Legal <br />Clinic explaining the neighbor`s concern had been submitted to the Board. <br />C. Remmel moved to grant the variance, seconded by R. Bugala, and unani- <br />mously approved. Law Director Gareau will acknowledge the letter from <br />Hyatt Legal Clinic. <br />8. Dale Hickle, 24258 Elm Rd. <br />Request for variance (1133.13). Request variance to place 30" fence on <br />vacant lot (adjacent to residence). Violation of Ord. 62-33, Section 1151.04. <br />Chairman Remmel called all interested parties before the Board. The oath <br />was administered to Mr. Hickle and Mr. Shipley, his neighbor, who questioned <br />what type of fence was to be installeda Since fence would be adjacent to <br />his drive, he would like it installed a couple of feet away. It was ex- <br />plained that fence can be right next to property line. He stated he is not <br />sure where property line is. Mr. Hickle advised that this will be a split <br />rail fence and he knows where property line is. Mr. Gundy stated that it <br />is the responsibility of the home owner to put the fence on his own property, <br />no survey is required. If fence is not on property, it would be a civil <br />matter and Mr. Hickle would have to remove the fence. There was a complaint <br />that Mr. Hickle was splitting and selling wood from his residence. He <br />claims that he split the wood and has been giving it to his family. Mr. <br />Bugala suggested that fence should be placed either to the front of the <br />residence next door or all the way to the rear of the house; not just a <br />piece of fence. Mr. Hickle agreed to put the fence to the rear line of <br />the neighbor's house. R. Bugala moved to allow the split rail fence on sub- <br />lot 17 to extend to the rear house line of the western adjacent neighbor's <br />home and that the fence, as constructed, meets all building code require- <br />ments, and that this variance shall apply only to this section of fence, <br />any additions must require another variance, seconded by C. Remmel, and <br />unanimously approved. Variance granted. Chairman Remmel advised Mr. <br />Hickle that the city would be checking to see if a business is being co.n- <br />ducted on the property. <br />9. National City Bank, 26440 Lorain Rd. <br />Request for variance (1133.13). Request front set back variance to add <br />A.T.M. enclosure. Violation of Ord. 62-33, Section 1174.02. Also request <br />special permit to add to non-conforming building. Special permission re- <br />quired Ord. 62-33, Section 1231.02. (Variance denied October 3, 1984. <br />This proposal differs because of altered traffic pattern). <br />Chairman Remmel called all interested parties before the Board. The oath <br />was administered to Mr. Skinner, the contractor. This is the same type of <br />enclosure, however, posts and wheel blocks will be installed so that cars
