4. BOARD OF ZONING APPEALS NOVEMBER 14, 1984 PAGE 2 3. Mr. & Mrs. Rasgaitas, 5136 Whitethorn Request for variance (1133.13). Request 18' rear yard variance for patio enclosure. Violation of Ord. 62-33, Section 1163.01. Also re- quest 9'9" variance for distance between enclosure and detached garage. Ord. 62-33, Section 1151.04-C. (Variance denied September 5, 1984). Chairman Remmel called all interested parties befor.e the Board. The oath was administered to Mr. Billington, contractor, and Mrs. Wares, a neighbor. It was clarified by Mr. Billington that this is only a patio enclosure and could not be converted to a year round room. Mrs. Wares is again objecting to variance because lot is small and will be crowded. She also has con- cerns that this will increase her existing water problems. Mr. Billington stated that the Rasgaitases would be willing to reduce enclosure to 10' instead of 12' and that he would conform to all codes and would provide drainage. Building Commissioner Gundy stated that if the Board so desired he would have the contractor deal with the Engineering Department regarding possible water problems. R. Bugala moved to accept the Rasgaitas variance based upon standards of a 10' by 14' enclosed proch, which will be tied into the storm sewer system as approved by the Building Department, seconded by J. Helon., and unanimously approved. Variance granted. R. Bugala moved to accept the Minutes of October 3, 1984 as submitted, seconded by C. Remmel, and unanimously approved. C. Remmel moved to excuse the absence of Mr. Graves, seconded by R. Bugala, and unanimously approved. The meeting was adjourned at 8:35 p.m. C. Remmel, B. Oring, rding Secretary
