Special permission re-
quired Ord. 62-33, Section 1231.02. (Variance denied Oct. 6, 1982.)
Chairman Remmel called all interested parties before the Board. The oath
/ was administered to Mr. T. Skinner, contractor and R.' Kline, manager of the
? bank. Enclosure is smaller, has clear glass, and is more open than the
v enclosure requested previously. Mr. Graves stated that he still has con-
cerns about safety in that.location since cars pull up so close to the
sidewalk; it is a bad situation without the enclosure. Board still be-
lieves that automatic teller machine should be relocated or the bank
should elirsinate all traffic in the front. Mr. Kline stated that they are
considering putting a drive-in A.T.M. at the rear of the building. He
will take the Boards thoughts back to the management. C. Remmel moved to
grant the vairance, seconded by R. Bugala. Roll call on motion: Remmel,
Bugala, Graves, and Helon, Nay. Motion failed to pass. Variance denied.
Chairman Remmel questioned why a tow truck is allowed.to park in a resi-
dential area at Deerfield and Hunter Drives, at a location where the Board
had previously ruled that a moving van could not be parked. He also stated
that he has seen the van there again. Mr. Gundy stated that the Building
Department has no way of knowing that the van was back unless they are
notified, either by the Board.members or the neighbors, or unless an in-
spector would see it during a routine inspection. He advised that in
two other cases where tractor/trailer cabs have been brought back, the
city is taking the owners back to court. As far as the tow truck is con-
cerned there could be some question as to whether it would fall under
this ordinance since the ordinance reads "trucks with a rated capacity of
one ton or over". Mr. Gundy is working with the police and the Law De-
partment to clarify this.
Mr. Remmel asked for the disposition of a violation he had reported on ,
Walter Road, where it can be presumed that the residents are repairing cars
as a business in a residential district. These records are in the Building
Department and Mr. Gundy will check into them; however, it was explained
