.?- <br />1.0 <br />PLANNING COMMISSION MARCH 13, 1984 PAGE 5 <br />the congestion in the left hand turning lane which will adversly eff ect <br />traffic entering his shopping center, and the "bowling alley" type lot <br />which could accommodate only one access to this large parcel. He be- <br />lieves that this rezoning will create a permanent hardship to his pro- <br />perty and that Bob Evans can build elsewhere in North Olmsted. Mr. Hill <br />stated his greatest concern is that there is no proposed use for the <br />rear two third of the property and that the one access must handle all <br />potential traffic. He believes that the present zoning is more appro- <br />priate, or at least if rezoned, it should be rezoned as Class "A" <br />High Rise (residential). Mr. Vollman of Bob Evans countered that the <br />restaurant would not draw 400 extra cars onto Lorain Road, that the <br />majority of customers would be normally using Lorain; one third of their <br />business is on Saturday and Sunday; the majority of their business in <br />the morning and then lunch hours, and that they would not permit any <br />business on the rear of the parcel that would be detrimental to the <br />restuararM, and that they will be using at least one half of their pro- <br />perty, not one third as was stated. Commission then discussed issue <br />pro and con. Safety Department had no objection. Building Commissioner <br />had avised Mr. Burns that under the current zoning property would <br />accommodate a five to twelve story office building and lot would be <br />buildable under current zoning. Mr. Burns stated that adjacent lots <br />which had been rezoned previously had more frontage on Lorain Road <br />and less depth. He has heard no arguments as to why lot cannot be <br />used as zoned and sees no reason to rezone property. A member of the <br />audience advised that this location would not be a.class "A" location <br />for an office building. Mr. Roberts stated that property had been <br />vacant for 25 years at the present zoning. Assistant Law Director <br />Dubelko advised that Planning Commission has to take into consideration: <br />if rezoning is in the best interest of the City; and that, if they don't <br />rezone, is this going to work an economic hardship to the owner; and <br />if property is rezoned, will it work an economic hardship on adjacent <br />property owners. J. Burns moved that Planning Commission reject the <br />rezoning request for parcel 236-2-2 located between the Zayre/Rini <br />stores and Ponderosa Restaurant/Kings Path Condominium, seconded by T. <br />Morgan. Roll call on motion: J. Burns and J. Brown, Aye. T. Morgan, <br />J. Roberts, E. Traczyk, and J. Wixted, Nay. Motion failed to pass. <br />T. Morgan moved to approve the rezoning request for parcel 236-2-2 <br />from existing Class "B" High Rise to Retail Business, General, seconded <br />by J. Roberts. Roll call on motion: T. Morgan, J.
