A petition had been submitted from <br />16 residents opposed to the variance. Neighbors spoke against the variance; <br />it would devalue their property, all other homes are single family, and <br />there are other vacant lots which might also request variances. Mr. Dress <br />stated that the lot has been for sale for 5 years at $2,000 below the market <br />value. He also feels that he would lose money if he builds a single family <br />home. House will conform in appearance to neighborhood and his father-in-law <br />would probably be the tenant. T. Restifo moved to grant the variance, seconded <br />by C. Remmel. Roll call on motion: Restifo, Remmel, Bugala, Graves, and <br />Horvath, Nay. Motion failed to pass. Variance denied. <br />6. Allan Wagner, 5454 Whitehaven <br />Request for variance (1133.13). Request 1' variance for fence. Violation of <br />Ord. 62-33, Section 1151.04H. . <br />Chairman Remmel called all interested parties before the Board. The oath was <br />administered to Mr. Wagner who exp].ained that the fence was on order at sale <br />V/ price and he would be putting in a pool next year. Board hesitated to grant <br />the variance since there was no assurance pool would be put in. Mr. Wagner <br />can store f ence when delivered and withdrew the request. <br />2. Graves moved to grant the variance, seconded by T. Restifo, and <br />unanimously approvede Variances granted. <br />7. Gregory & Jeanne Fox, 24661 Florence Ave. <br />Request for variance (1133.13). Request 16' rear yard variance. Violation of <br />Ord. 62-33, Section 1163.01. Also request special permit to add to non- <br />conforming dwelling. Special permission required Ord. 62-33, Section 1231.02. <br />Chairman Remmel called all interested parties before the Board. The oath was <br />administered to Mre & Mrs. Fox. Mr. Fox explained that property adjacent to <br />theirs in the rear is an odd shaped lot that faces Walter Rd. There is no way <br />that the backland can be developed. They have an agreement with the owner that <br />she will sell a 25' deep portion to them before she sells the remainder of <br />the property. The rear yard would then conform. E. Graves moved to grant the <br />variance and special permit, seconded by C. Remmel, and unanimously approved. <br />Variance and special permit granted. <br />8. Ben K.
