?
r
,
BOARD OF ZONING APPEALS MAY 10, 1983 PAGE 2
lines frequPntly abut side lines on corner lots and cul-de-sacs.
Attorney Dorchak stated that in the Minutes of February 3, 1982, the
Board of Zoning Appeals had declared sublot 26 an unbuildable lot
since the Minutes state "It was observed that the lot to the rear
was not buildable because there is an East Ohio mineral right res-
ervation on the property". There is no gas well on sublot 26. Law
Director Gareau stated that the variance was granted for Mr. Bosak's
lot and there was no way the Board could declare some other parcel
an unbuildable lot. Mr. Bosak stated that he built his addition so
that he could enjoy his back yard, and now there will be a 37' high
wall 41 feet away from his addition. Attorney Sheppard stated that
the complainant had created his own condition because he requested
the variance for the addition. Exhibits "E" and "F" were submitted
by Mr. Shepard; exhibit "E" shows playground equipment presumably
belonging to the Bosak family on s/1 26 and exhibit "F" shows the
Bosak addition for which the variance was granted. h1r. Dorchak
stated that it was questionable to arbitrarily label the side yard
and rear yards as such. Mr. Bugala stated that no variance tzad
been required for the lot at the time of the subdivision, and the
subdivision plat was accepted by the City, and legally, it must be
considered a buildable lot. Mr. Sheppard submitted the copies of
drawings of Tallwood Subdivision approving the sewers by the City
of North Olmsted Engineer on February 9, 1977 and subsequently, ap=
proved by the Ohio Enviornmental Protection Agency on February 11,
1977 and logged with the City on February 15, 1977. These plans
were received by the City as proper. Mr. Bosak pointed out that
the adjacent neighbor`s front yard would be next to this property's
rear yard. C. Remmel moved that the Board of Zoning Appeal's in-
terpretation of the lot 26 is that the rear line is the easterly
line shown on the plat to be 76.71 as shown on the Apri1 19, 1983
survey and grading Plans, also termed sublot 26 of Tallwood Estates
Subdivision surveyed by the Henry G. Reitz Engineering Co. by
Donald E. Woike, seconded by T. Restifo, and unanimously approved.
The meeting was adjourned at 7:35 p.m.

C. Remmel, Chairman
B. Oring, eecording Secretary
