? <br />r <br />, <br />BOARD OF ZONING APPEALS MAY 10, 1983 PAGE 2 <br />lines frequPntly abut side lines on corner lots and cul-de-sacs. <br />Attorney Dorchak stated that in the Minutes of February 3, 1982, the <br />Board of Zoning Appeals had declared sublot 26 an unbuildable lot <br />since the Minutes state "It was observed that the lot to the rear <br />was not buildable because there is an East Ohio mineral right res- <br />ervation on the property". There is no gas well on sublot 26. Law <br />Director Gareau stated that the variance was granted for Mr. Bosak's <br />lot and there was no way the Board could declare some other parcel <br />an unbuildable lot. Mr. Bosak stated that he built his addition so <br />that he could enjoy his back yard, and now there will be a 37' high <br />wall 41 feet away from his addition. Attorney Sheppard stated that <br />the complainant had created his own condition because he requested <br />the variance for the addition. Exhibits "E" and "F" were submitted <br />by Mr. Shepard; exhibit "E" shows playground equipment presumably <br />belonging to the Bosak family on s/1 26 and exhibit "F" shows the <br />Bosak addition for which the variance was granted. h1r. Dorchak <br />stated that it was questionable to arbitrarily label the side yard <br />and rear yards as such. Mr. Bugala stated that no variance tzad <br />been required for the lot at the time of the subdivision, and the <br />subdivision plat was accepted by the City, and legally, it must be <br />considered a buildable lot. Mr. Sheppard submitted the copies of <br />drawings of Tallwood Subdivision approving the sewers by the City <br />of North Olmsted Engineer on February 9, 1977 and subsequently, ap= <br />proved by the Ohio Enviornmental Protection Agency on February 11, <br />1977 and logged with the City on February 15, 1977. These plans <br />were received by the City as proper. Mr. Bosak pointed out that <br />the adjacent neighbor`s front yard would be next to this property's <br />rear yard. C. Remmel moved that the Board of Zoning Appeal's in- <br />terpretation of the lot 26 is that the rear line is the easterly <br />line shown on the plat to be 76.71 as shown on the Apri1 19, 1983 <br />survey and grading Plans,also termed sublot 26 of Tallwood Estates <br />Subdivision surveyed by the Henry G. Reitz Engineering Co. by <br />Donald E. Woike, seconded by T. Restifo, and unanimously approved. <br />The meeting was adjourned at 7:35 p.m. <br /> <br />C. Remmel, Chairman <br />B.
