. <br />CITY OF NORTH OLMSTED <br />BOARD OF BUILDING CODE APPEALS <br />MINUTES - SEPTEMBER 24, 1981 <br />I. ROLL CALL: <br />Called to order by Vice Chairman J. Patton, at 7:35 pm <br />Present: J. Patton, J. Kasak, R. Puzzietiello, and R. Tallon <br />Also Present: E. Gundy, Building Commissioner <br />Absent: B. Schulz <br />II. MINUTES: <br />The minutes of June. 24, 1981 and July 30, 1981 were approved as read. <br />III. NEW BUSINESS: <br />Chairman Patton called applicant David Margo.lius and all other interested <br />parties to assemble before the Board. This hearing will be in regards <br />to Jamestown Village Apartments, 4809 Columbia Road, requesting permission <br />to use non-metallic sheathed cable for wiring in a multiple family resi- <br />dence. This request is in violation of Ordinance #75-110, Section 1357.03, <br />(b ) . <br />Jamestown Village Apartment owner Mr. David Margolius, identified himself <br />and introduced project architect Frank Ruzsa, and construction superin- <br />tendent Richard Margolius. Architect Ruzsa explained the project as 32 <br />multi-family units classified under OBBC as type IV Frame Protected. There <br />will be 9600 square feet between fire wa11s. He considers these units as <br />separate, self-contained, and no different from a single residential dwell- <br />ing where Romex is a permitted use by the City. Superintendent Margolius <br />detailed his study, and contacts with other munidi:Felities including fire <br />and building departments, and personally considers the use of Romex safe. <br />He further mentioned that Romex will decrease the cost of the electrical <br />installation by approximately 25%. The material is approved for use by <br />the National Electrical Code and the Ohio Basic Building Code. Mr. Tallon <br />admitted that;the cost of Romex would be less but in the consideration of <br />this request his concern is to prevent loss of life, personal injuries, and <br />property damage, which the existing Ordinance #75-110 is addressing, and <br />was originally adopted to do. Owner Margolius stated for the record,. his <br />concern for safety and would not authorize any construction that would <br />jeopardize his tennants. Member R. Puzzietiello feels that there is over- <br />whelming physical evidence that the material is safe. Chairman Patton <br />observed that this amendment was developed in 1975 and that the Board at <br />that time must have been deeply concerned about the high density of people <br />in multiple family units, also that several multiple family areas have been <br />developed since 1975 using the accepted electrical installations as required <br />by Code. A motion was made by Mr. Tallon to not grant the variance in this <br />instance. Seconded by Mr. Kasak. The roll call on the motion was: Tallon <br />yes, Kasak, yes, Patton yes, Puzzitiello no. Motion carried. Request denied.
