Sinte__this is not a <br />major addition, the Commission believes that the plans pre- <br />sented by Mr. Prest would be acceptable to the Architectural <br />Board of Review. Mr. Prest will be doing some of the work <br />himself and will be subcontracting a part of it. R. Perla <br />moved to refer the Jack's Auto Body addition to the Archi- <br />tectural Board of Review, seconded by J. Brown, and unani- <br />mously approved. <br />IV. NEW DEVELOPMENTS AATD SUBDIVISIONS: <br />(1) Andrew Rizzo Rezoning Request. Proposal is to rezone three <br />(3) parcels, 232-10-45, 232-10-46, and 232-10-47, located on <br />the east side of Por•ter Rd. north of Lorain Road, from the <br />currect Class "B" residence, Single Zone to Retail Business, <br />General Zone. Held in CouIInittee October 27, 1981. <br />J. Burns moved to take the Andrew Rizzo Rezoning Request out <br />of committee, seconded by R. Perla, and unanimously approved. <br />Mr. Rizzo was not present. In answer to the Planning Commis--- <br />sion's request for a legal opinion, Assistant Law Director <br />J. Dubelko advised that Section 1124.04 pertaining to the <br />General Retail Business area being on Lorain and Brookpark <br />Roads was not applicable to this request. He also stated <br />that Planning Cosunission, as the platting authority, could <br />approve or disapprove any rezoning request based on the best <br />interest of the city, in the case of a rejection the request <br />is not automatically forwarded to Council. The petitioner <br />may, if he so desires take the request to Council, in the event <br />of an approval by Council, the reauest must then be referred <br />again to Planning Commission. A two-thirds vote of Council <br />would then be required to over-ride Planning Commission's <br />rejection. The neiohbors aoain voiced their objections to the <br />rezoning. T. Morgan moved that the Andrew Rizzo rezoning <br />request be denied since the properties mentioned in this re- <br />quest have been platted as residential property and the de- <br />velopment of these properties as corunercial lots is not in <br />the best interest of the City of \orth Olmsted, seconded by <br />J. Brown, and unanimously approved.
