West Haven FoLmdation for the Retarded, 25991 Butternut Ridge <br />Request for variance (1133.13). Request variance for Home :for <br />mentally retarded in Single Family Area. Violation of Ord. 62- <br />33, Section 1125.26. <br />Decision of-Board of Zoning Appeals in Reference to Case No. 1 <br />The Board met on July 16, 1980 to decide the within appeal. <br />Pursuant to Section 1133.13 of the Zoning Code the Board voted <br />on each standard specified in said section namely 1133.13 (A), <br />(B), and (C). <br />A roll call was taken with respect to 1133.13 (A) which section <br />reads as follows: <br />(A) The practical difficulty or unnecessary hardship, which <br />is inherent in and is peculiar to the premises sough t to be <br />used because of physical size, shape, or other character- <br />istics of such premises, or adjoining premises, which <br />differentiate such premises sought to be used from other <br />premises in the same district, and as to such premises <br />sough t to be used, will create a difficulty or hardship <br />caused by a strict application of the provisions of the <br />zoning Code not generally shared by other lands or <br />structures in the same district.
