<br />, <br />BOARD OF ZONING APPEALS FEBRUARY 6, 1930 PAGE 2 <br />of Ordinance•62-33, Sectioii 1159-B. <br />Chairman Ledvina called all interested parties before the Board. The oath <br />was administered. Chairman Ledvina explained that the minimum sq. footage <br />for a commercial lot-should be 25;000 not 2,500 as stated on the application <br />and on the agenda. R. Mongello, Architect, explained the request. A <br />portion of this lot is being leased for a gas station and the appelant <br />wants to subdivide the'lot in order to construct an office building on <br />the rear portion with a driveway entering on to Clague. It was observed <br />that there was a lot of traffic congestion at this intersection, and that <br />when the front portion of the lot was leased the owner was aware that . <br />the remaining segment would be non-conforming. The present lease for the <br />gas station should expire in'approximately 5 years. If the lease is not <br />renewed this lot would be a legal conforming lot, if it is subdivided <br />then neither parcelwould be conforming.- C. Remmel moved to - grant the <br />va-riance.?. seconded by D. Ledv3na._ Roll call on motion.:_ Messrs. Remmel,_ <br />Ledvina, Horvath and Wasni.ak,_Nay. Motion failed tD- pass. Walter pominick of Speedy Muffler King stated that this <br />business opened on December 22, 1979 and that this would be advertising the <br />grand opening of the store.? C. Renmel moved to grant the variance for the <br />temporary, portable sign for a 30 day.peridd with the condition that there <br />be no flashing. light. and that the sign- must have a neutral background, <br />seconded by L. Horvath, and unanimously approved. Variance granted. <br />7. William J._Metzger, 23117 Marion Rd. Request for variance (1133.13). Request 5'6" variance for distance be- <br />tween house and detached garage. Violation of Ord. 62-33, Section 1141.04 C <br />Also request special permit to add to nonconforming dwelling (40' front set <br />back). Special permission required Ord. 62-33, Section 1161.01.
