? <br />? <br />? <br />CITY OF NORTH OLMSTED <br />130ARD OF ZONIIIG APPEALS <br />NINUTES - DECEMSER 5, 1979 <br />Chairman Ledvina called the meeting to order at 7:30 p.m. <br />Present: D. Ledvina, C. Remmel, L6. Iiorvath, E. DeVoto <br />Also Present: Law Director M. Gareau, Building Commissioner E. Gundy, <br />Councilman Wilamosky, and Recording Secretary B. Oring <br />Law Director M. Gareau administered the oath of office to new member <br />W. Ldasniak. <br />l. James E. ltiThite, 23852 Amesbury Dr. <br />Request 1' 10" total side yard variance for fireplace. Violation <br />of Ord. 62-33, Section 1161.01. Chairman Ledvina called all interested parties before the Board. <br />The oath was administered. This variance is to enable the construction <br />of a fireplace. L. Horvath moved to grant the variance, seconded <br />by E. DeVoto, and tmanimously approved. Request granted. <br />2. Appellant not present at this time. <br />3. Richard Balinski, 4299, Clague Rd. <br />Request for variance (1133.13)o Request 3' total side yard variance. <br />"- Ordinance 62-33, Section 1161.01. Also request for Special Permit <br />to add to non-conforming dwelling. Special permission required Ord. <br />62-33, Section 1231.02. <br />Chairman Ledvina called all interested parties before the Board. <br />The oath was administered. A neighbor was inquiring as to whe"tner <br />or not a survey would be done and if there would be proper drainage. <br />He was advi.sed that a survey was not required and that the drainage <br />? would have to be approved by the Engineering and Building Departments. <br />There will be 6" between the driveway and the property line, but <br />there will be a curb along the driveway to eliminate any drainage problem <br />on to the adjacent property. C. Remmel moved to grant the variance and <br />the special permit as requested based on the Building Department and <br />the Engineering Department approval of the grade on the driveway, <br />seconded by L. Horvath, and unanimously approved. <br />2. Edwin A. Green, 27956 Southern Ave. <br />Request for variance (1133.13). Reques t 2' variance for fence on <br />corner lot (3' set back from sidewalk). Violation of Ord. 62-33, <br />Section 1151.04 H. <br />Chairman Ledvina called all interested parties before the Board. The <br />oath was administered. This will be a 6' chain link fence, 3' in <br />_ from the property line to enclose his swimming pool on a corner lot.
