Mr. Steve Sarascon, <br />- the contractor, representing Mr. Slaba.ugh, came before the Boardm Applicant <br />had been previously granted a rear yard variance and therefore the rear yard <br />is short of the 50' requirement. Proposed fireplace will be visible from the <br />rear yard of adjacent property owners. Mr. Fairfield made a motion to grant <br />the request. Mr. Renunel seconded and motion passed unanimously: _ <br />5. Samuel J. Costello, 23949 Birch Lane. Request for variance.(1133.13). Request- <br />for 3' variance to erect a swimming pool 7 feet from two-adjacent property=lines. <br />Violation of ord. 62-33 section 77-128 (L).- Request for special permit to add <br />to a non-conforming attached garage. Garage is non-conforming by.virtue of <br />set-back. Building Department records do not.show any variance granted in 1957 <br />when house was-built. Request 4' side yard variance for attached garage on corner <br />lot.- This variance would allow garage t o be 13'_ in from sidewalk off Coe Avenue. <br />Violation -of ord. 62-33 section 1159._02_ _requiring. a 25' set-back. : <br />• Chairman Ledvina requested the applicant and all other interested persons to. <br />assemble before the Board. Also he.is <br />asking that the swimming pool be 7' fr-om sidef rear lines inS tead of 10' • in <br />order to preserve a large tree on his property: He needs a variance of 3' on <br />those two lines. Mr. Remmel moved to grant the side line variance for the <br />swimming pool and also the 4' sideyard special permit. Mr._Fairfield seconded <br />and motion passed unanimously. <br />- 6. Neighbors-would rather have-a lower <br />fence in order=- to-. be ab-le__to see the woods=-fr.om- their-backyards.Mr.- St.orch==-= - <br />said the- ferice is .absolutel_y_-to- preven-t-balls- and' children- f-rom-going-beyond--'- <br />that- par-ticular- point; - as well--as=-to--keep= -the_ children from _ going--into -the ="-- <br />ditch. The neighbors.felt-that._a_6' fence would accomplish_this just as well <br />as a 12° fence-would. -Mr.- Fairfield moved to-deny-the variance for- a 12' fence <br />and readapt--it to a.6' fence.
