BOARD OF ZONING APPEALS SEPT. 6, 1978 PAGE 2 Chairman Ledvina requested the applicant and all other interested persons to assemble before the Board. The oath was administered. Mr. Steve Sarascon, - the contractor, representing Mr. Slaba.ugh, came before the Boardm Applicant had been previously granted a rear yard variance and therefore the rear yard is short of the 50' requirement. Proposed fireplace will be visible from the rear yard of adjacent property owners. Mr. Fairfield made a motion to grant the request. Mr. Renunel seconded and motion passed unanimously: _ 5. Samuel J. Costello, 23949 Birch Lane. Request for variance.(1133.13). Request- for 3' variance to erect a swimming pool 7 feet from two-adjacent property=lines. Violation of ord. 62-33 section 77-128 (L).- Request for special permit to add to a non-conforming attached garage. Garage is non-conforming by.virtue of set-back. Building Department records do not.show any variance granted in 1957 when house was-built. Request 4' side yard variance for attached garage on corner lot.- This variance would allow garage t o be 13'_ in from sidewalk off Coe Avenue. Violation -of ord. 62-33 section 1159._02_ _requiring. a 25' set-back. : • Chairman Ledvina requested the applicant and all other interested persons to. assemble before the Board. Also he.is asking that the swimming pool be 7' fr-om sidef rear lines inS tead of 10' • in order to preserve a large tree on his property: He needs a variance of 3' on those two lines. Mr. Remmel moved to grant the side line variance for the swimming pool and also the 4' sideyard special permit. Mr._Fairfield seconded and motion passed unanimously. - 6.
