City of North Olmsted <br />BOARD OF ZONING A Pt E.AI.S <br />February 4, 1976 <br />Chairman Ledvina called the meeting to order at 7:30 P.M. <br />PrESent: Mes.srs. Ledvina, Duskey, Huntington and Hamill. <br />Also tresent: Building Commissioner Gundy, Law Director Gareau and Recording <br />Secretar}r Hodginso <br />Mr. Huntington moved January 7, 1976 minutes be approved as read. Mr. Duskey <br />seconded and motion passed. <br />The first case is to be considered later in the meeting. <br />2. Robert Storch' 440L Martin Dr. Request for variance (1133.13). Request <br />for 5 ft. side.yard variance on corner lot for garage. Violation of Ord. <br />62-33 Section 1159.01o <br />. <br />Present: Mr. and ?7rs. Storch. Witnesses were administered the oath. <br />Gase and ap-peal were read. Plans were explained by Mr. Gtorch <br />and examined b,y Board Memberse An effort is being made to save <br />trees. Mr. Huntington moved to approve plan as submittedo ivIr. <br />Duskey seconded and motion passed. <br />3. James D. McKenna, 27875 Gardenia Br. Request for variance (1133.13). Re- <br />quest for variance for size of tool shed (13 ft. x 10 ft.) Violation of <br />Ord. 75-117 Par. D. limiting tool shed size to 100 sq. ft. <br />Present: AZrs. N1cKenna who was administered the oath. Case and appeal_ were <br />read. Also included in the request should be location of tool <br />shed. Metal shed is planned. There is no screening in rear yard. <br />Shed is needed for storage of b lawn mowers. P•4r. Hamill moved to <br />reject the request. iMr. Huntington seconded and motion passed. <br />Request rejected. <br />l. Carl G. Pfaff, ?635 Fleharty Rd. Requesting clarification of zoning Ord. <br />62-33 Sections 1174,06 and 1163.02, pertaining to the Helen S. Browr. Sub- <br />division. <br />Presents Mr. ?'faff and P4r. Peters. Zditnesses were administered the oath. <br />Mr. rfaff's letter of protest was read by Chairman Ledvina. Mre <br />Gundy had computed measurements in accordance with ruling of the <br />Board in 1966e Question arose as to whether portion of property <br />in question is side yard or rear yard or can there be two rear <br />lot lines. This is an irregular parcel. Lengthy discussion fol- <br />lowed. It is concensus of Board Members present that short pi-eces <br />are indeed rear line and parallel to the street. Mr. Huntington <br />moved the Board overrule decision of the Building Commissioner <br />and building as shown is in violation of 50 ft. rear yard, abut- <br />ting residential.
