Board of Zoning Appeals 10-1-75 <br />-3- <br />? he will have to look at the situation. Mro Ernest then asked <br />where Mro Hi11 would consider th e best location fo r multifamily <br />residenceG. Mr. Gareau objected to the question; that is not <br />purpose of the meeting. Chairman Ledvina said the question be- <br />for the Board is - is this a permitted use or what does our <br />existing ordinance say. <br />Mrs. Gla dys Zipp asked - you say adjoining multiple residence; <br />that you cannot build an apartment on Zorain Rd. unless it backs <br />onto multiple? Mr. Hill replied that as far as multifamily zon- <br />ing on Lorain Rd. it would seem to him that two conditions must <br />exist - either it must be zoned to permit multifamily use or a- <br />apartment development or it could be accomplished in a general re- <br />tail busirie ss district providing that the parcel zoned general <br />retail business is adjacent to multifamily zoninga Mrs. Zipp <br />said she backs onto Netropolitan Park and is zoned general retail <br />business and can build a 5 story apartment. Cha irman Ledvina sti- <br />pulated the Board is not trying to determine the use of Mrs. Zipp's <br />property - that is not the questian before the Board. Mrs. 2ipp <br />stated she believes Mr. M7nest sold his property to the Metropoli- <br />tan Park Board, so whatever decision pertains to both parcels. She <br />was told by Mrm Ernest that the rear of his property is zoned B <br />residential. Mr. Ernest was told if the rear of his property is <br />zoned B residential9 then the only thing allowed on his property <br />would be B residential, or A residential. <br />? A resident asked if Mr. Hill has ever advised North Olmsted on <br />planninge Mr. Gareau asked Mr. Hill to again state the dates on <br />which he served as advisor to the city. Mr. Hill said that he <br />doesn't believe he ever said that he served the Cit.y of Nor th <br />Olmsted and he has not. <br />Chairman Ledvina asked for questions or comments from Board members. <br />Mr. 01son asked for clarification. He was told by Mr. Hill this <br />provision is in every zoning ordinanee that has been prepared by <br />the Regional Planning Commission. Discussion followed in which Mr. <br />Hill explaired that provi.sion is in the ordinance for a permitted <br />use anywhere in our retail business district for a single family. <br />Dlr. Hill added that a least restrictive use would be multifamily <br />so that an interpretation could' be that single family would be a <br />permitted use. iNe'w legislation as proposed taill be more specific. <br />Mr. Ernest submitted to Board members the wording as it is in the <br />code is ambiguous. Chairman Ledvina said we are governed by wha t <br />is in toda,y's law. <br />Lav, Director Gareau .asked I+'Ir. Hill - suppose that you have a par- <br />cel of land adjacent to a multifamily district, what requixements <br />or limitations would govern with respect to the development of <br />that general retail land in developing it for multifamily use? <br />In other words, sa,y, there is a 2T story limit? The answer was <br />that conditions that exist in the adjacent property would have <br />? to be applied in the business district, at least meet the re- <br />strictions of th e adjacent property. <br />Law Director Gareau asked Mr. Hill if he had had co nversations <br />Recycled Bond - One etep to eave our environmeat
