Zoning Board of Appeals 7-2-75 ° 5- <br />Tom Ruffing kas ad.ministered the oatha He spoke of multi-family versus <br />apartments and asked about children in the apartments. He said there <br />would be tendeney for any children to go into the Brettan Ridge Recrea- <br />tion area. He spoke of previous case regarding a tool shed and was ru1- <br />ed out of order. <br />athers were administered the oath at this time: Ted Eckbreth spoke of <br />trash and tenant problems; Henry Bufford spoke of traffic exits; Al Stinn <br />cited problem of housing and parking cars for apartment tenants; and Mro <br />Engelville also had questions. <br />Gladys Zipp asked why f,his question has come up at this time when the <br />City has spent $221800.;on one plan and $25,000 on another for Lorain Rd. <br />zoning. In 1968 the opinion was for commercial along Lorain Rde for 500 <br />ft. back for 5 story apartment buildings. She ha.d bought what she thought <br />was comriercial. <br />The question again came up if this is for ruling or variance. <br />Delmar Ernest, 30106 Lorain Rd. said there are many permitted uses under <br />the codeo Will the Bretton Ridge people suggest type of use for this <br />property to which Bretton Ridge residents will not object? Mro Ernest <br />read Sections 1127.01 and 1133.07 and asked if it is proper to hear a <br />case based on an opinion of the Law Director. Law Director Gareau said <br />he was asked for an opinion by Councilman T?iilamosky, He further stated <br />Sl.anning Commission had rejected the Simmons apartment plan. <br />John N.atzel asked if the apartmentG could be sold off as condominiums. He <br />-vias told there is no section in the code regarding this. <br />Mrs. Leaderbach asked Mr. Simmons how long ago he had anticipated building <br />apartments after he had built Lawson store. Mr. aimmons replied after the <br />Lawson store was built all along he thought he could build apartments. He <br />further stated there will be more than the minimum parking provided. <br />Mr. Ernest referred to Planning Commission minutes of June 10 and 24 at <br />which times plan was presented and showing no variance reguirements. <br />Charles Long was administered the oath. He asked since Lawson is paying <br />rent, will they permit cars to drive from apartments through parking lot? <br />Richard Parker was administered the oath. He asked if this Board approves, <br />will apartments as planned be built. Mr. Gareau said it is too early to <br />tello <br />Question was asked regarding subdivision of the two parcels. Mr. Simmons <br />said the.y are in process of being subdivided. Question was asked if 35 <br />ft. rear yard req_uirement is upheld what will Mr. zimmons do? Mr. 9immons <br />said something will have to be moved around. Richard Parker said apartment <br />will face Christman Drive, rear yard will face the drivewayo <br />Ha.rr,y Babcock asked if plan tiaill have to go back through Planning Commis- <br />sion if it is o.k.ed here. He was told Planning Commission has rejected <br />the plan. Use is the question before this Board. <br />Gary (?) asked about economic hardship.
