Oviatt, J. arens., J. Esgar. <br />T1r. Harris was absent. <br />A special meet was cal.led for the Planni.ng Commi.ssion to check the plat of <br />the Westches'uer Estates Subdivision No. 1. <br />1-dr. Oviatt made a motion that the Planning Comriiission accept the Westchester <br />Estates Sub-Division No, 1 plat as showr_, to the easterly terminus of pro- <br />posed lot Noo 25, piovided tne developer furnishes satisfactory bond to cover <br />cost of improving said proposed Westchester Drive with sewer, sid.eyaallt' road <br />and water in confox7nity to. the requirements oi' the Council of the Cit,r of <br />North Olmsted or in the alternative, cash to be deposited titiTith the City to <br />cover the cost of any or a].l of the said improvements together vrith a copy <br />of the contract properly entered into with a contra.ctor for one or more of <br />said improvements; and developer shall also furnish copy of deed restrictions <br />for said aLlotment and a sa-tisfactory easement for an easterly turn-around <br />as indicated on a proposed addendum, to be incorporated and rade a pa.rt of <br />the proposed dedication plato Thn mo'uion ti•ras seconded by Mr. Esgarm <br />Motion was passed. <br />ADDENDWii TO VIESTCI-ESTER SUBrDIVISI0N <br />In order to provid_e an area of lan.d suitable for nractica.l turn-around pur- <br />poses from the ea.sterly extremity of proposed Westchester Drive, the follow- <br />ing public easement is granted to the City of North Olmstedm <br />ir1e, the Westchester Estates, Incorporated' do hereby give9 grant, bar- <br />gain ancl convey to the Citf of North O:Lrnsted' an easement for pub'-ic road <br />passage and usa;e on and over land described as followss <br />I'ro:a .a cent,er point of ti;lestchester Drive forty feet in a general easterly <br />direction froln the extended east terminus oi lot ;T25 on the attached lot' such <br />point sha1.l constitute the center of a 40-ft, radius circle' upon wlzich land <br />the said Udestchester Estates, Incorporated sha1l construct a Macadam-surfaced <br />thorouohfare f'or the purposes aforementioned, the performa.nce of such improve- <br />ment t,o be o ara.ntead by the posting of bond as required. Sai-d easement, however,, <br />is to become operati Te only upon condition that -the saicl Vdestchester Estatss, <br />Incorporated, for any reason whatsoever, fail.s to extend Westchester Drive be- <br />yond the point and place no:a evidenced in the atta,ched plat as its terminus. <br />In the event that Westchester Estates, Incorporated,does extend Westchester <br />Drive beyond the #25 extended lat line, this easemsnt shall be inoperative, nuLl <br />and void and of no effect 4atsoever. <br />_ (Signed) P.
