Public Hearing 2/17/59 Page 2 <br />? <br />Mr. Knappik asked for information as to State Law regarding the <br />hauling of school children. <br />Mr. Moore of the Board of Education reported that the Board of Education <br />had gone on record, not to oppose official of Shell Oil. <br />Bob Pehlen of Theresa Lane sug$ested that the ordinance be upheld. <br />Mrs. Douglas stated her insurance representative had stated insurance <br />rates of adjacent properties would be increased. <br />Mr. McKinney spoke of interview with State Board regarding insurance <br />rate. The Board stated exposure rate applied to distance within 50 feet <br />of station. <br />Mr. NTohr of the Board of Education reported insurance representative <br />stated no increase in rates on the school building. <br />Mr. Hugg asked if school board had explored possibility of purchase <br />of subject property. <br />Mr. Folleyg principal of Coe Schoolg reported on rights of condemnation <br />necessity of proving need of land for school use. He felt that this <br />neeessity could not be proven. Reported other schools near gas stations <br />had no hazards. <br />Mrs. Jensen, Columbia Road, spoke of traffic and hazards. <br />Mr. Fenwick spoke of lack of control of station by Shell Oil Co. Spoke <br />of violations under the ordinance. <br />Mr. Folley stated that he had never stated he wanted a gas station on <br />this property but he had said he preferred a gas station to a drive-in. <br />Miss Patton said lease of drive-in expired in June of 1958. They <br />have had many inquiries for lease or sale of the property for various' <br />usesa She felt Shell Oil Co. would be the best user from a safety <br />standpoint. <br />lTrs. Jensen spoke at length of safety, of purchase of subject sitey of <br />increased insurance rates, of inereased traffic and objee:ted5tTenuously <br />to erection of gas station. <br />Mr. Douglas says the lot is now used by mothers delivering children <br />to achool. <br />Mrs. Douglas asked what control Shell Oil would have over leaser. <br />Mr. McKinney stated they had control through short term leases. <br />It was moved by Mr. Lindsay that the appeal be granted. The motion <br />was seconded by Mr. Klinite. "Yea" Mr. Lindsay; "Nay" Mr. Klinite <br />and Mr. Parker. Thereforey the appeal wras not granted. <br />? Chai man <br />Secretary
