P. <br />Reference: Back yard footage variances of from 9 to 13 feet on proposed <br />homes with attached garages to be built in the Walter-Maple <br />Subdivision ti,rhich is loeated in approximately the 3400 block <br />East off Walter Road, between Maria Lane and NTaple Ridge Rdey <br />N. Olmsted, Ohio. Builder is asking for variances on Sublots <br />2 thru 48 inclusive. <br />Violation of Zoning Ord. 62-33, Chapter 1163. <br />Appellant advises that no homes have been built in this development as yet. <br />Model homes are proposed f or Sublots 31 and 32e A.11 wiring in this development <br />will be underground. <br />Approximately 40 interested neighbors present at this meeting strongly objected <br />to shortening of the back yard. There would be no objection, however, to talcing <br />the required footage from the front of the houseo Neighbors would prefer the <br />building of a better home with attached garage rather thaii a cheaper home if the <br />variances could not be granted. <br />It was the opinion of Law Director Mr. George Schaaf that the Board of Zoning <br />Appeals was no-t in a position to change the building line from 50e to 35'. This <br />would require action by Council. . <br />The Board will submit this matter to Council at once zqith the recommendation <br />tha.t the buildipg plat be changed to 35' set back building line. Board did <br />not take action on back ya.rd variance requests. <br />4. Appellant: PZr. J. Parliak, 4292 W. 214 St., Fairview Park, Ohio. <br />owner o home occupied by Mr. and Mrs. Dan Siegel, <br />3087 Walter Rd., N. Olmsted, Ohio. <br />Present at meeting: Mr. J. Parliak; Mr. &kIrs. Dan Siegel; <br />Mrm & kTrs, Stanley K?ng, 3105 Walter Rdo, neighbors originating <br />complainto <br />Bcth Mr. Siegel and Mr. King have installEd side line fences between their <br />homes, fences caithin the heights as stipuiated in the Codee Hoiaever, Mr. Siegel <br />has alsc planted tall arborvitae evergreen trees on his side of fence. Board <br />4ras asked its interpretati-on of whether or not this would be considered a <br />"living fence" and in vioZatien of Zoning Ord. 62-33, Cha.pter 1151.04 (H). <br />It was the Board9s decision that the planted evergreens constitute a Living Fence <br />and is in violation of the Code. <br />Meeting adjourned at 9;30 P.M. <br />. <br />2 <br />?"?- <br />?- <br />Chairman Sec'Y
