Francis Ruzsa and ivIr. John Supple <br />ReferencP: Insufficient room for a 601 Dedicated Roa.dway in Subdivision <br />proposed for the S.E. corner of Columbia and Brookpark, <br />N. Olmsted, Ohio4 <br />This matter was referred to the Board of Zoning AppeaZs by the Planning Commission <br />through a letter dated December 2, 1963, wnich 1e'uter reads as follows; <br />"The Flanning Commission finds reason to reject the proposed subdivision of <br />the Hayes Corp. due to the insistance that a dedicated 60 foot roadway be <br />included in a].1 proposed subdivisions for the health, welfare and safety oi <br />the Cityo <br />°The Planning Commission hereby recommends that a variance be given by the <br />Zoning Board of A,ppeals to perriit a 24 to 30 foot road right-of-way in this <br />proposed subdivision with an ingress into the adjoining properties and a <br />sidezralk or other improvements beneficial to the City be included at the <br />discretion of the City Engineer, <br />"It is further recommend.ed that the Zoning Board include the entire proposed <br />48 unitis of this projeet due to the reduction of land area used for these <br />dedicated purposesO This special consideration is based on the nature, loca- <br />tion., and individual merits of this particular area.'? <br />Signed Ysy Mr. Anthorty T a LaPonza, Secretary <br />North Olmsted FZanning Commission <br />Board felt -that this did not require a Public Hearing as no one is affeeLed but the <br />builderg <br />4ppellant proposes garden type apartments for perman ent type residentse Area is <br />zoned for this purposee Creation of a 601 street would ruin proposed plans. <br />.kppellant asks permission to build a 24t to 30Y marginal road. No one but the <br />builder wi11 be affectedo Appellant will naL- be blocking development of other <br />land; and they will grant easements for other developers to use the streeto <br />Granting of reduced size cf righ-t of way will not reduce the size of the building <br />area. Parking will be off the public highway, fteduction of from 60e to 24, or <br />30t, and the fact that this right of way exists as an easement' would rot adversely <br />2ffect., the density proportion as required by Ord. 62-33. <br />Mr. Greene moved tha.t appellant be granted permission to create this marginal <br />road as set forth in their plans and speciiication, such plans and speeifications, <br />however, to be submittPd to the Planning Commi.ssion and City Engineer ior final <br />approval.
