Eian' Messrs. Greene9 Byers, Nelson and Scheef. <br />Also present: iqr. C?.Lndy9 Building Commissioner <br />MMinutes of July 279 1966, snecial meeting were approved as receivedo <br />lp jlppellantm Peter D. Kleist' 1-jest 232nd Sto Fuilding, Inco, W. 232 and <br />Lorain ttd,, Tdorth OJ?nsted <br />Request for variance (1133.13) to construct an addition on the <br />Buckeye Restauranto Request is in violation of 1174.02 of the <br />Zoning Ordinance which states in retai:L business d.istrict build- <br />ing setback sha11 be at least 50, from street line; Section <br />1231m02 3, which states a noncon.f.`ormixig building shall not be <br />altered, added to or enlarged unless the additions and original <br />buzlding are made to conform to the yard9 coverage and hea.ght re- <br />'gulations of the district z.n which it is locaved. <br />IAr. Robert E. Kasper, attorney, rep-resented the firm'. and presented the plans <br />for the addita.on. He said addition is necessary to provide banquet and meeting <br />room faciJ.ities, the addition to be made at rear of building.. Yir. Delmonico, <br />who manages -the restaurant and resides in house i.mmecia.ately to the rear of the <br />building, was presentm Mr. Kasper sfiated building was built in compliance with <br />code when erected 3n 1958. A cYange in setback restrictions in the code since <br />that time9 made the buildirg nonconforming. <br />Mr. Creene explained i;he Board of Zoning Appeals has no alternative but to turn <br />down a request f or var.;.ance to add to a nonconfotming building. In hearing <br />simil.ar requestsin the past, Mrm Kitchen9 Zaw Di.rector, has stated Section <br />1231.02 (B) is specific and the Board does not have authority to grant a variance. <br />Yir. Greene further explained -that upon receivang a denial from t,he Board of <br />Zoning Appeals9 the appellmt can take the appeal to courtQ <br />Mro Kasper stated he felt iq-ro Kitchen's in-terpretation of the ruling was not <br />correc-t' and said he idould like to confer Vaith him. 14r. Nelson made a motion <br />that this request be tabled until the SqDt. 7, 1966 rmeting, so that Mr. Kasper <br />can consul.t with Mr. Kitchen.
