Zoning Board of Appeals 10/lt/72 - 2-
a of property. The garage is too small. Mrs. Eian moved to grant special
permit to erect tool shed. Mr. Rober-ts seconded and the motion passed
unanimously.
I?. Theodore J. Fiala, 3986 Dryden I?r. Request for variance (1133.13) for
special permit to erect tool shed in violation of Ord. 62-33 Section 1133•09.
Present: Theodore Fiala, Leonard Hirz, Paul Winslow, Mrs. Fiala. ._ ,
YJitnesses were administered the oath. Mr. Fiala submitted note from neighbors
who do not object to 8' x 12' tool shed, but state it must be maintained in a
neat and orderly manner. Lot is 75 ft. wide and 155 ft. deep. The shed is
to be located 60 ft..from house and there is swale in back. Mr. Hirz and Mr.
Trdinslow stated they think the tool shed seems rather large and perhaps it
should be up against the house. Mr. 'Pubbs explained Zoning Board Hearings.
Mrs. Fiala said her husband must store carpeting in garage and they need
shed for storage of garden tools, etco The development on Dryden is new,
it is Canterbury Woodso There are attached garages in the area. Mr. Tubbs
expressed the opinion that the shed structure is too large in relation to
house and lot. Is the lot wooded? Yes, quite a few trees, but they will
not hide the shed from the street. The shed is to cost $600000. NIr. Tubbs
said the attached garage is to avoid free standing buildings and make for
better appearance. Messrsv Hirz and Wins:lo.w believe there is a deed restric-
tion. There have been different builders and one developerm The developer
establishes the deed covenants. Fialas' deed does not tell of restrictions.
Mr. Scheef said the deed may refer to plat books. Mr. Scheef said he under-
stands their need, but this shed would be bad for neighborhood. These mini
barns are the very best kind of sheds, but unsuitable in this instance.
Truck and car parked in driveway might solve Fiala nroblem, but create an-
other problem in t he area. Mr. Scheef moved to deny the request for special
permit to erect tool shed. Mr. Roberts seconded the motion, suggesting some-
thing closer to the home be built, perhaps addition to home. Motion passed
unanimouslys
5. Theodore Sielatycki, 25080 Arlington Lane. Request for variance (1133.13) of
2ft. to erect fence. Violation of Ordo 62-3? Section 1151.04 limiting height
of fence to 4 ft.
Present: Theodore Sielatycki.
Witness was a.dministered the oath. Mr. Tubbs read the request. Nr. Sielatycki
needs screen to screen out debris, trucks, cans, etc. of retail business kCar-
riage Carpet) which is very elose. Desired fence is to be 40 ft. long. Ques-
tion was asked why does not Carriage Carpet pay for fence? They have plant-
ings but this is not enough. There are high trucks with carpeting. Mr.
Sielatycki expected more of a buffer. He is only 20 ft. from commercial. One
or one and one-half years ago permit for Carriage Carpet was granted. Law
Director Kitchen has already researched the problem as to why Carriage Car-
' pet was not requested to have more of a buffer. Mro Scheef moved to grant
request for 2 ft. variance to erect fence. Mrs. Eian seconded and motion
passed unanimousl.y.
End of hearings.
July 12 minutes of Zoning Board of Ap-peals were approved as submitted.
Se,ptember 6 minutes of Zoning Board of Appeals were approved as submitted.
