Violation of Ord. <br />62-33 Section 1151e04 limiting height of fence to 4 ft. <br />Present: Damn Marie Janik <br />Witness was administered the oath. She has cyclone fence around backyard. She <br />needs 4 ft. variance on east side of rear side. The Board had letter from 5 <br />neighbors with no objection. Mrs. Janik moved the lst of Nay to present ad- <br />dress. Neitbor Michalko threw stones at German Shedpard with pups and came <br />after husband and brother with ax. There is police report. She needs protec- <br />tion and asks for 8 fte fence 150 ft. long. She will remove cyclone fence and <br />replace with basket weave fencc. The dog does not go over 3 1/2 fat fence. <br />Mr. Tubbs asked if strangers can come into her yard. No. Husband is away <br />much of the -time. Dog is children's pet. Mr. Scheef :1°Nobody can build a <br />fence to solve a problem of this kind. Police problem or civil problem. This <br />would be aspite £ence. Sirrnlar case before the board. Fence perpetuates the <br />problem. It might aggrevate neighbors into other prablems. Have the police <br />talk to him; have lawyer write letter. Then go to court". Mrs. Janik: 'rTnihy <br />allow something to happen to somcone?'R Mr. Scheef said fence would not solve <br />problem. N?,r. Tubbs suggested planting trees in front of existing fence for <br />sound and vision barrier providing more privacy. 12ndscaping does not alienzte <br />as fence does. Others do not knotia of spite with added landscaping as they do <br />with fence. Ns. Scheef moved the request be denied. Mr. Roberts seconded and <br />the motion passed. <br />11. Appell.ants Hugh E. Espe. 3 6254 Christman I}r. Request for special <br />permit (1133•13 to erect tool shed in viol.ation of Ord. 62-33 <br />Section 1133009. <br />Present: Mr. Espey <br />j^Jitness was administered the oath. Plat was oxnined by thc Board. The tool <br />shed to be 8 to 12 inches from garage 2nd to be made of fabricated steel. Size <br />to be 10 ft. xo 8 ft. x 6 ft. high. The lot is 70 fts wide and 150 ft. deep. <br />Nlr. Scheef asked if there are deed covenants restricting tool shed. There is <br />Architectural Committec for Bretton Ridge, but perhaps it is only eerbal. Nir. <br />Tubbs suggested attaching tool shed to garage and yariance will not be needed. <br />It would look better. Bui1d one of wood with door and roof. Mr. Espey has z <br />covered patio. All he wou ld need to do would be to bring plans and zpplication <br />to Building Departmento N1r. Scheef moved request for variance be denied. Mro <br />Roberts seconded and the motion p2sseds <br />12. Appellant: H. Elizabeth Romano, 4357 Coe Ave. Request for vari- <br />ance (1133.13 e Rrquest for 2 ft rear fence variance. Violation <br />of Ord. 62-33 Section 1151.04 limitin¢ heioht to 4 ft. <br />Presentr Mrs. Romano and so n and neighbor. <br />t^litnesses were administered the oath. Mrs. Romano wants fence to enclose property <br />and kecp animals properly enclosede There is chain link fence adjoining proposed <br />fenceo She has cats and labrador retriever. Stockade fence is requested. Neigh- <br />bors have partial fences and without va.riances she believes. che is requesting <br />6 ft. fcnce instead of 5 ft. because that is the wa.y they come and 6 ft. will <br />blcnd better Ujith the landscaping. Her yard is path for children on way to both <br />public and pxi rochial schools. Mr. Gundy said there were some variances granted <br />for existing fences.
