Board of Zoning Appeals 11-13074 - 2- <br />Chairman Hamill read as follows: <br />"The Board aFter a review of all of the evidence finds that <br />1. There is an unnecessary hardship inherent in the <br />premises which would be caused by strict applica- <br />tion of the code; <br />2o Refusal to grant a variance would deprive the owner <br />of substantial property rights; <br />3. The granting of a variance would not be contrary to <br />the intent of the Zoning Codea <br />"Therefore the Board grants the following variance: <br />l. The 50 fto buffer requirement shall be reduced to <br />20 ft. as relates to contigtzous residential prvper- <br />ty <br />2. The requirement of 16 units per acre is variad and the <br />Board will permit 19.7 units per acre or a maximum of <br />248 suites of garden type plus 70 suites in the six <br />story building.°P <br />l. Appellants are rid of <br />chickens, they had citation. Shed is not stabilized. Mrs. <br />tiiarner has no objection to tool shed, but did object to the <br />chickens. A'Irs. Aidonis has no objections. NTrs. ir?aaftngton <br />questions moving of tool shed on state property and asked <br />if it will house animals. Drawing shows nothing. Mr. Lec3vina <br />moved to continue until more informatian is submitted, Mr. <br />Duskey seconded the motion. Motion passede Ntro Gundy said <br />he will notify State of Ohio to remove the tool shed. Mr. <br />Isdvina moved to rescind firs't motion and maved to reject re- <br />quest. There is no <br />uniqueness nor hardship in this case.
