Board of Zoning Appeals 2-6-74 - 2- <br />2o Bauer Development, <br />Request for 10 ft. <br />1i59.o1e <br />Inc., 6011 Paisley Dr. Request for variance (1133.13)• <br />front setback variance. Violation of Ord. 62-33 Section <br />Present: Mrs. Karkut representing Mr. Bauer, Mr. Speedling and Mr. Daur. <br />Documents were examined. Mro Daur does not object. The request <br />is for esthetics. Mr. Roberts moved to grant 10 ft. front set- <br />back variance. Mr. Duskey seconded. Motion passed with all Board <br />members voting aye except Mr. Hamill who abstained. <br />3. Richard A. Cook, 23775 Curtis Dr. Request for variance (1133.13)• Request <br />for height variance for fence in tree lawn. Violation of Orde 62-33 Section <br />1151804 Pare H. <br />Present: Mr. Cook who was administered the oath. Case and appeal were read. <br />Mr. Cook stated hardship exists because cars are on tree lawn, side- <br />walk and main lawn. A petition with names of neighbors in favor of <br />granting variance was submitted. A list of 22 police calls was sub- <br />mitted, more violations were not reported to police. Fence in tree <br />lawn must be approved by Planning Commission and Council. Split <br />rail fence taas suggested as minimum construction as there is ques- <br />tion and concern regarding visibility. There is vandalism of Mr. <br />Cook's property. Neighbors have complained concerning delineators <br />installed by the City. Entrance is made between driveway and Curtis <br />off Plumwood. There is no street light at cornere Mr. Ledvina mov- <br />ed Secretary send letter recommending the following Board suggestion <br />- one more delineator be installed closer to drive and one street <br />light be installed on utility pole. Mr. Ledvina also included in <br />his motion this case be reviewed at the May meeting of Board.of Zon- <br />ing Appeals. Mr. Tubbs seconded and motion passed unanimously. <br />Mr. Ledvina left the meeting at this time. <br />4. John Guzik, 4709 Lansing Dr. Request for variance (1133.13)e Request for <br />variance for special permit to build addition to non-conforming dwellingo <br />Permission required by Ord. 62-33 Section 1231002. <br />Present: 14r. Guzik, Mrs. Singer and Mrso McQuaid. Witnesses were administer- <br />ed the oath. Home is U5.6 fto from rear lot line. Neighbors have <br />no objection. Mr. Duskey moved special permit be granted to build <br />addition to non-conforming building. Mr. Roberts seconded. Motion <br />passed. <br />Mr. Tubbs moved minutes of January 9s 1974 meeting be approved. Mr. Duskey seconded <br />and motion passed. <br />Question was asked Law Director Gareau concerning hardship attendant to the property. <br />Mr. Gareau explained and directed Board Members' attention to Ord. 62-33 Section <br />1133.13 beginning on Page 29. <br />Meeting adjourned at 9:15 p.m. <br />i <br />2 <br />?011 ?.
