Compliance Inspection Reports written on October 13, 2011 and again on January 23, 2012 which were submitted. He reviewed the process for closing a service station permanently and/or temporarily. The 28925 Lorain Road Gas Station is an illegally out of service gas station in accordance to BUSTR procedures. Mr. O'Malley questioned what the BUSTR deadline was for the site and Mr. Davis said the location has until March 23, 2012, which is a total of 60 calendar days to comply. Mr. Davis was asked if, in accordance with ORC, is the 28925 Lorain Road site an abandoned station and he said yes. Mr. O'Malley asked if BUSTR has had any response to the written violations and Mr. Davis said there has been no reply to the citations issued. Mr. Papotto asked if the 28925 Lorain address had any insurance in place and Mr. Davis said July 1 st of each year all insurances must be in place, and to date the 28925 Lorain address has not paid for their tank registration, insurance or their petroleum board since 2010. Mr. O'Malley advised the board to be consistent with the state and set the filing deadline date of March 23, 2011. Ms. Sabo moved, seconded by Mr. Papotto, to adopt the report dated January 11, 2012 from Building Official Dale Mitchell determining that the 28925 Lorain Road, former Clark Gas Station property, to be abandoned and presents a danger to public health, welfare and safety in accordance to ORC 3791.12 based upon evidence given by BUSTR representative David Davis, which passed 4-0. Ms. Sabo moved, seconded by 1VIr. Boncek, that the Board of Building Code Appeals hereby issue an order to the owner of 28985 Lorain Road to repair, replace, remove and abate the dangerous conditions not less than 30 days from today's date, or on or by Maa-ch 23, 2012, the underground storage tanks, piping, valves and pumps be drained and otherwise made secure in accordance with state law, which passed 4-0. Ms. Sabo inoved, seconded by Mr. Boncek, that if the abandoned service station at 28925 Lorain Road is not abated by the owner not less than 30 days and/or by March 23, 2012 the City of North Olnxsted is authorized to enter the land and secure the premises in accordance to ORC 3791.12, which passed 4-0. The clerk is to serve the board's orders to the property and lien holders by ordinary and certified mail. The board's orders are to include the BUSTR citations dated 1/23/12. Mr. O'Malley thanked Mr. Davis and BUSTR for their cooperation.
