BOARD OF ZONING APPEALS <br />CITY OF NORTH OLMSTED <br />MINUTES OF NOVEMBER 4, 2013 <br />ROLL CALL <br />Ms. Rudolph called the meeting to order at 7:02 p.m. in Council Chambers and led the Ple.dge of <br />Allegiance. <br />Present: Jennifer Rudolph, Maureen Diver, Laura Bellido, Michael Raig, Alfredo Lopez <br />Staff: Director of Law Michael Gareau Jr., Planning Director Kim Wenger, Clerk of <br />Commissions Donna Rote <br />REVIEW AND CORRECTION OF MINUTES <br />Ms. Bellido moved, seconded by Mr. Lopez, to approve the minutes of October 7th and 21St, <br />2013 which passed 5-0. <br />RESIDENTIAL APPEALS AND REQUESTS <br />CMS13-37: Jennifer Jancek; 27751 Blossom <br />Proposal consists of a shed. The following variances are requested: <br />1. A 120 sq. ft. variance for a shed larger than code allows; code permits 120 sq. ft., applicant <br />shows 240 sq. ft., Section 1135.02(d)(1). <br />2. A variance for an accessory structure over 200 sq. ft. without a masonry/cement foundation; <br />code requires masonry/cement foundation, applicant shows none, Section 1135.02(d)(1). <br />3. A 4 inch variance for a storage shed higher than code allows; code permits 9 ft., applicant <br />shows 9 ft. 4 in., Section 1135.02(d)(1). <br />4. A variance for no drainage (gutters and downspouts); code requires drainage for 200 sq. ft. <br />and over, applicant shows none, Section 1135.02(d)(1). <br />The oath was administered to homeowner Jennifer Jancek and neighbor Greg Follen. Ms. Jancek <br />said she purchased the shed from a company in North Ridgeville that assured her they would <br />take care of all permits and worked within North Olmsted often. She purchased the shed to store <br />her work trailer and other outside equipment. She noted a number of items which she has had to <br />store outdoors under tarps which she is trying to clean up. The shed also blocks the rear <br />neighbors flood light which illuminates half her house nightly. Mr. Follen said the shed is twice <br />the size allowed for the lot as well as taller than what is allowed, if variances are granted it will <br />set precedence for other structures of this size to be constructed in the neighborhood. The <br />stability and durability of the structure is questionable as it wasn't installed to code nor <br />inspected. The structure will adversely impact the neighborhood and should not be allowed. Ms. <br />Jancek asked if the neighbors would rather see yard tools and trailer left outdoors under tarps or <br />put away neatly in the shed. <br />Ms. Wenger said a few years ago the city updated the code to a sliding scale to accommodate lot <br />sizes and this structure is double what is allowed by code.
