BOARD OF ZONING APPEALS <br />CITY OF NORTH OLMSTED <br />MINUTES OF FEBRUARY 4, 2013 <br />ROLL CALL <br />Ms. Rudolph called the meeting to order at 7:00p.m. in Council Chambers and led the Pledge of <br />Allegiance. <br />Present: Jennifer Rudolph, Maureen Diver, Laura Bellido,.Michael Raig, Alfredo Lopez <br />Staff: Law Director Michael Gareau, Jr., Building Commissioner James McReynolds, Clerk <br />of Commissions Donna Rote <br />BOARD ORGANIZATION <br />Ms. Bellido moved, seconded by Mr. Lopez, to elect Ms. Rudolph Board of Zoning Appeals <br />Chair which passed 5-0. <br />Mr. Lopez moved, seconded by Ms. Rudolph to elect Ms. Bellido Board of zoning Appeals <br />Vice Chair which passed 5-0. <br />REVIEW AND CORRECTION OF MINUTES <br />Mr. Raig moved, seconded by Mr. Lopez, to approve the December 6, 2012 minutes as <br />written which passed 5-0. <br />RESIDENTIAL APPEALS <br />Caushi; 28646 Lvnhaven <br />Proposal consists of a fence; the following variances are requested: <br />1. A 3 foot height variance for privacy fence beyond front building line; code permits 3ft, <br />applicant shows 6ft, Section 1135.02 (fl). <br />2. A variance for privacy fence beyond front building line; code requires 50% open, applicant <br />shows 0%, section 1135.02 (fl). <br />Note: A permit to install a fence was issued 4/15/12 for a 30inch high fence 50% open however <br />upon final inspection the fence installed was a 6ft privacy fence. <br />Ms. Caushi the owner was administered the oath. Ms. Caushi said when they moved into their <br />home in 2011 the inspector came out to their home and advised them as to what could be <br />installed. However after moving in she had to undergo a hip replacement which has limited her <br />mobility. Therefore for the safety of their small children the six foot board on board fence was <br />extended the additiona125 feet, to the outside edge of their home. Mr. McReynolds said the <br />permit issued by the building department showed the fence would be installed to code. However <br />upon final inspection the fence installed although brought inward 24ft to the edge of the home is <br />still in the neighbors front setback therefore requires the varianee. Ms. Diver questioned why the <br />fence was not installed in accordance to the permit issued. Ms. Caushi said since the fence was <br />only installed to the edge of their home instead of to the sidewalk they thought it would meet
