foot buffer area will be preserved and monitored in perpetuity. The residentially zoned portion of <br />232-34-016 is so small as to be inconsequential to the overall development of the parcel. The <br />residentially zoned area, in terms of the development plan, is part of the conservation easement <br />area. The main purpose of the rezoning for this parcel would be to clean up the zoning boundary <br />line to match the parcel boundary line. Ms. Wenger supported approval of the rezoning. <br />Mr. O'Malley stated that the easement is under review by the Law Department, but they approve <br />of the requirements listed in it. He added that the Charter in Article 7, Section 2 states that the <br />Planning and Design Commission is responsible for reviewing ordinances regarding rezoning <br />and land use classifications. He pointed out that the commission should examine whether the <br />land belongs in the residential or commercially zoned district. Mr. O'Malley agreed with Ms. <br />Wenger's comments regarding rezoning parcel in a manner that is consistent with the Master <br />Plan. Mr. Anderson supported the rezoning after seeing the proposed changes in the site <br />development plan at the previous meeting. . <br />Bruce Bruehler, 4440 Root Road, reviewed the history of the land since he has owned his <br />property. He stated that in 1986 the Council promised to keep the parcel residential. Six years <br />prior to this, Ganley bought other parcels which remain zoned residential but are paved over <br />now. He is concerned that other commercial properties would be interested in rezoning their <br />abutting residential parcels if this precedent is set. <br />Vern Davis, 25610 Timber Cove, stated that he was concerned about the Ganley landscaping. He <br />did not believe that the landscape plans of the car dealerships are cohesive. He believed that the <br />landscape plans along Lorain Road could be more consistent and become a focal point of the <br />city. He added that there have been people who missed his street due to the confusion caused by <br />the car dealership driveway location. <br />Council's public hearing for the rezoning will be October 11t' at 7:30 in Council Chambers and <br />the BZD committee meeting is scheduled to follow. <br />Mr. Schumann moved, seconded by Mr. Anderson, to recommend for approval by Council <br />Ordinance No. 2016-75, motion passed 5-0. <br />NEW BUSINESS <br />16-7001; Scott Purtan; 4823 Bailev Road <br />Representative: Scott Purtan, owner <br />Proposal consists of consolidating two parcels (PPN 236-04-017 & PPN 236-04-018) located at <br />4823 Bailey Road, resulting in a single parcel of 0.2362 acres. Mr. Purtan stated that he just <br />wants to consolidate the two parcels with no construction planned at this time. The house sits on <br />both parcels. Mr. Schumann believed the request was reasonable. <br />Mr. Schumann moved, seconded by Mr. Anderson, to approve the lot consolidation plan <br />for 16-7001; Scott Purtan; 4823 Bailey Road, motion passed 5-0.
