r
Motion denied 1-4, Mr. Raig voted yes.
16-5300; Sean Kellv; 5997 Barton Road
Representative: Sean Kelly
Proposal consists of an accessory building. The following variances are requested:
1. A 380 sq. ft. variance for the maximum accessory storage building size; code permits 300
sq. ft., applicant shows 680 sq. ft., Section 1135.02(d)(1).
2. A 5 ft. variance for the maximum height of an accessory structure; code permits 12 ft.,
applicant shows 17 ft., Section 1135.02(d)(2).
Note 1: Lot size is 77,100 sq. ft. per the County.
Mr. Kelly said the proposed building would be on the same spot the existing accessory structure
is on. The footprint would be increased by adding a second story. The lower level of the building
would be used for lawn maintenance equipment and the upper loft area would be used for
storage. Mr. Allain clarified that this proposal would be replacing the existing accessory
structure because there is no footer to build on. The house does not have a basement, but other
houses in the neighborhood do have them. Mr. Kelly stated that the structure may be taller than
the house since it is a split level house. He said the structure would be 100 feet away from the
house and down grade so it should not be a noticeable difference in height. Mr. Allain stated that
Mr. Kelly has a unique situation since there is no basement, did not think the proposed building
goes against the spirit of the neighborhood. Mr. Papotto agreed that the building would not look
out of place but was concerned about the height of the structure in relation to the house. Mr. Raig
stated that there was not much room allotted for storage when homes were built in the past.
Mr. Raig moved, seconded by Mr. Allain, to grant a variance as conditioned upon removal
of shed per applicant's request for 16-5300; Sean Kelly; 5997 Barton Road to build an
accessory structure with the following variances:
1. A 380 sq. ft. variance for the maximum accessory storage building size; code permits
300 sq. ft., applicant shows 680 sq. ft., Section 1135.02(d)(1).
2. A 5 ft. variance for the maximum height of an accessory structure; code permits 12 ft.,
applicant shows 17 ft., Section 1135.02(d)(2).
Motion passed 4-1, Ms. Meredith voted no.
16-5321; Marv Izzo; 4573 Ranchview Drive
Representatives: Mary Izzo; Matt McMillen, Budget 1 Fence; Janelle Rolen, Fence Warehouse
Proposal consists of a new fence. The following variances are requested:
1. A 6 in. variance for the maximum height of a fence in the front yard; code pernuts 30 in.,
applicant shows 36 in., Section 1135.02(fl(1).
Note 1: Height of the fence is measured from actual grade to the highest point of the fence,
which includes the finial.
Mr. McMillen stated the dirt from fence post holes was added to the fence prior to measuring the
fence posts which adds to the height of the fence. He stated that he was aware of the code when
he built the fence. Discussion of the actual height of the fence. Ms. Rolen stated that the French
