?._ . . • <br />Zimmerman stated that the mound is 40 feet from the road but the reflectors are about 1 foot <br />away. <br />Mr. Allain stated that the applicants have not proven that the additiona160 inches of fence <br />increases safety. Discussion about the hardships required for granting a variance. No evidence of <br />noise reduction and increased safety has been shown. Mr. Papotto stated that the road grade is <br />above the property grade. He believed it looks nice and pointed out that the applicants took the <br />time to ask the neighbors and no one seemed to have objections. Ms. Meredith stated that the <br />fence has not been proven to increase safety since it is set back so far from the road. She stated <br />that the applicant has not proven any hardship and Mr. Allain agreed. Mr. Gareau asked that the <br />seven factors be read into the record. Mr. Raig stated that the fence looks like more of a <br />landscape feature, rather than a fence. Ms. Sabo stated that the Board needs to look at the <br />structure as it is currently, not how it is planned to be. She also agreed that there are other ways <br />to reduce noise and increase safety within the zoning ordinances. <br />Ms. Meredith moved, seconded by Mr. Papotto, to grant 16-5175; Caleb Zimmerman; 6190 <br />Fitch Road the following variance for a fence in the front yard: <br />1. A 60 in. varianee for fence in the front yard; code permits 30 in., applicant shows 90 in., <br />Section 1135.02(f)(1). <br />Motion denied 1-4,1VIr. I2aig voted yes. <br />ADOPT 12ULES & REGULATIONS I+'OR BZBA <br />Mr. Raig stated that the order of business will be changed so that miscellaneous items and <br />communications will be addressed after the commercial cases.
