16-6273; Mike Imperatore; 23916 Beaumont
Representative: Mike Imperatore, owner
Proposal consists of a 20' x 16' deck. The property is zoned One Family Residence C.
The following variance is requested:
1. An 18 ft. variance for rear yard setback; code requires 50 ft., applicant shows 32 ft., Section
1135.08.
Mr. Aspery said the applicant is requesting a variance of 18 feet to allow for the addition of a 20
ft. by 16 ft. deck to the rear of their existing home. The current rear yard setback is 50 feet, so the
proposed porch would reduce this number to 32 feet. This number accounts for a 2 foot
protrusion shown in the submitted drawings. Code requires a rear yard setback of no less than 50
feet. Mr. Imperatore stated that he would like to build a deck to complement the home and finish
the home to allow an exit for the existing sliding doors. The home was built in 1999 and the
applicant would use vinyl railings to go with the house materials. His wife is handicapped and
the deck would provide easier access to the yard. He did not believe that the deck would interfere
with the view of the neighbors. Ms. Meredith stated that the applicant has a 6 ft. privacy fence
already and did not think that the variance would harm the abutting property owners. Mr. Papotto
pointed out that one of the neighbors has a similar size to the proposed deck.
Mr. Fapotto moved, seconded by 1VIr. Allain, to grant the following variance as written for
16-6273; Mike Imperatore; 23916 Beaumont:
1. ELn 18 ft. variance for rear yard setback; code requires 50 ft., applacant shows 32 ft.,
Section 1135.08.
Motion passed 4-0.
16-6380; Paul & Diana Heyse; 25122 Antler Drive
Representative: Diana Heyse, owner
Proposal consists of an accessory structure. The property is zoned One Family Residence C.
The following variance is requested:
1. A 16 square foot variance for an accessory structure (shed); code permits 80 square feet,
applicant shows 96 square feet; section 1135.02(d)(1).
Mr. Aspery stated that the applicant is requesting a variance to allow a 96 sq. ft. shed in the rear
yard. Code allows for an accessory structure up to 80 sq. ft. based on the lot size, therefore
requiring a variance of 16 sq. ft. for the proposed shed. All setback and height requirements have
been met as indicated in submitted plans. Ms. Heyse said that the previous shed was in disrepair.
The owner has a one-car garage and there is not enough room for storage. The attic is only made
of trusses and is unable to be used for storage. The proposed shed is taller than previous shed but
the footprint will be the same. The applicant will also be applying to complete the fencing
around the back yard. Mr. Raig pointed out that the shed is already built.
Ms. Meredith moved, seconded by Mr. Allain, to grant the following variance for 16-6380;
Paul & I)iana Heyse; 25122 Antler Drive:
1. A 16 square foot variance for an accessory structure (shed); code permits 80 square
feet, applicant shodvs 96 square feet; section 1135.02(d)(1).
1VIotion passed 4-0.
