1. A variance for the location of an animal shelter, code prohibits shelters to be located within <br />200 ft. of a dwelling on any adjacent lot, applicant shows the location is less than 200 ft.- <br />from dwellings, Section 1135.02(e)(1). <br />Mr. Aspery stated that the applicant is requesting to construct an 8 foot by 8 foot chicken coop <br />on their property located at 4480 Martin Drive. He clarified that while Section 505.19 of the <br />General Offenses Code regulates the keeping of domestic farm animals on private property, the <br />scope of the Board's review falls entirely within the zoning regulations found in Chapter <br />1135.02(e)(1). He added that the proposed coop falls short of the required 200 foot minimum <br />distance for 2 nearby homes on adjacent lots: 4456 Martin Drive, at 180.61 feet, and 28786 <br />Oring Road, at 177.98 feet. The required 10 foot rear and side lot line setbacks have been met <br />based on the submitted drawings. <br />Mr. Babjak described their rationale for locating the coop as shown and clarified that the coop <br />will be 8 feet by 12 feet. He added that it will be regularly cleaned, well-maintained and <br />surrounded by landscaping to make it more aesthetically-appealing. Mr. Aspery asked the Board <br />to consider not only the zoning regulations but also the quality of life impact that these structures <br />may present to neighbors if not sited properly. He noted that the applicant proposes to construct <br />their coop to be as equidistant as possible from all nearby home and, given that there are no <br />nearby water sources or other unusual siting issues that would create a burden for neighbors, this <br />appears to be an ideal location for the applicant to construct their coop. Mr. Papotto asked Mr. <br />Aspery to explain the certificate of zoning compliance, with Mr. Aspery clarifying that it is an <br />additional administrative step to ensure that the coop will be in compliance with what is <br />permitted either by code or a result of the Board's decision. Mr. Allain and Mr. Raig expressed <br />their agreement with Mr. Aspery's assessment of the proposal, noting no objection from <br />neighbors. <br />Mr. Allain moved, seconded by Mr. Papotto, to grant the following variance for 17-10307; <br />Ray & Karen Babjak; 4480 Martin Drive: <br />1. The property is zoned One Family Residence B. The <br />following variance is requested: <br />1. A 5 ft. wide variance for the expanded width of a driveway; code permits a driveway to be <br />the width of the attached garage, applicant shows 5 ft. wider than garage, Section <br />1135.02(2)(c). <br />Mr. Aspery stated that the applicant is requesting a variance for driveway width at their home at <br />6258 Somerset Drive. Code requires a driveway providing access to an attached garage be no <br />wider than the width of the garage whereas the applicant shows their proposed driveway
