Papotto, to approve the Building & Zoning Board of <br />Appeals minutes of May 15, 8017 as written, motion passed 3-0. <br />RESIDENTIAL APPEALS AND REQUESTS <br />17-8631; Chris & Maria Rufener; 5842 Barton Road <br />Representatives: Christopher and Maria Rufener, owners; John Davis, 5862 Barton Road; <br />George Shumay, 5820 Barton Road; Michael Martin, 5518 Barton Road; John Christoff, 5851 <br />Barton Road; Paul Schumann, Ward 3 Councilman <br />Proposal consists of an existing fence. The property is zoned One Family Residence B. <br />The following variances are requested: <br />1. A 6 in. variance for fence height, code permits 6 ft., applicant shows 6 ft. 6 in., Section <br />1135.02(f)(1). <br />2. A variance for exposed posts or supporting cross-elements that face the public right-of-way <br />or a lot other than the lot on which the fence is to be constructed; code does not allow <br />exposed posts or cross-elements unless both sides of the fence are the same, applicant shows <br />exposed posts where the sides of the fence are not the same, Section 1369.04(c). <br />Mr. Aspery stated that the applicant is requesting variances permitting an existing solid wood <br />fence along their northwestern and southwestern property lines, as marked in the submitted site <br />plan. The northwestern property line abuts the Barton-Bradley soccer fields. Code permits a <br />fence up to 6 feet in height, whereas the applicant shows a maximum fence height of 6 foot 6 <br />inches. Additionally, a variance is required permitting a fence with different sides. Code requires <br />that fences or screen walls be the same on both sides and be erected so that no exposed posts or <br />supporting cross-elements face the public right-of-way or any lot other than the lot on which the <br />fence is to be constructed. The applicant is proposing to construct a 12 foot by 8.5 foot addition <br />to the west of their hoine. A variance is requested permitting a side yard sum of less than 20 feet; <br />code requires 20 feet, and the applicant show 12 feet 3 inches. Note that the existing property is <br />non-conforming with a width of 40 feet; code requires width of 60 feet. A variance is also
