The <br />ground sign along Lorain Road is pre-existing and they feel the size and width of the lot <br />warrants a ground sign for the Porter Road entrance. <br />Resident's comments: <br />Mr. Trapp questioned if the applicant had submitted any, written documentation showing that <br />they meet the three requirements for the use permit and the seven factors for the area <br />variances required. He questioned if the applicant could show the residents something in <br />writing showing past variances granted. He inquired how the residents could view any <br />documentation regarding past variances granted. Mr. Maloney advised that residents could <br />contact the Clerk to receive past meeting minutes pertaining to the KIA lot. Mr. Trapp felt <br />that if the applicant's reasoning for their variances being granted is based upon past variances <br />granted, then the applicant should present those documents, otherwise past granting's were <br />irrelevant. <br />Mr. Felleisen presented county website documents showing the property scheduled to be <br />demolished zoned residential, not commercial as the applicant stated. Mr. Rymarczyk advised <br />that although the home has been used residentially the lot is zoned commercial. Mr. Felleisen <br />aslced why the same mounding style would not be placed along the Porter property line. Mr. <br />Holter voiced that he had not heard the applicant show a hardship nor the seven factors for the <br />area variances being requested. He did not believe that the applicant was doing anything to <br />accommodate the abutting residents. Ms. Kellar questioned if the applicant was aware that the <br />salesmen were conducting business in the area which was to be for storage of cars only. She <br />questioned how the residents could believe that if the use variance was granted, the applicant <br />would abide by it. She questioned when the expansion of the dealership would end as it <br />continues to engulf more and more residential properties. Mr. Maxim asked the applicant if <br />he purchased lots 232-10-026, 027 & 028 knowing that they were zoned residential, and if so <br />why is he not using them as such. He questioned what the applicant's hardship was as the <br />applicant could sell the lot or build a home and rent it out. Ms. Wright questioned if the <br />Porter Road entrance would remain in the same location or be moved further north. She also <br />asked if deliveries would be mad'e from the Porter Road entrance. <br />Mr. Maloney read aloud a letter the board received from Mr. Pacsuta voicing concerns with <br />the following variances: lighting, building addition, expansion of car storage area and would <br />like the step down fence replaced with a larger fence. From his front door, he can look onto <br />the lot. He would like a well built around the tree and the fence placed on top of the well to <br />close the field of view of the dealership. Mr. Kula believed that his dealership was struggling with the lack of <br />parlcing space and needs all the spaces they can get. Mr. Kula did not believe that anyone <br />would want to purchase the vacant lot to build a home and he did not want to sell the lot. Mr. <br />Suhayda believed that since the vacant lot was bordered by commercial property, he doubted <br />anyone would want to develop the lot as residential, and the owner does not want to use the <br />land as residential. The new curb cut would be centered at the current opening and narrowed <br />down to a 54-foot triangle. Mr. Kula 'reviewed that all del'ivery trucks would enter the lot at <br />the Lorain Road entrance and circle behind the building. Once the delivery truclcs are <br />downloaded they would leave the lot via the Porter Road driveway. <br />3
