CITY OF NORTIH OLMSTED <br />BOAIZD OF ZONIIeTG APPEALS <br />JULY 07, 2005 <br />MINUTES <br />I. ROLL CALL: <br />Chairman Maloney called the meeting to order at 7:40 pm. <br />PRESENT: Chairman J. Maloney, Board members; W. Kremzar, and M. Diver <br />ALSO PRESENT: Assistant Law Director B. O'Malley, Assistant Building Commissioner T. <br />Rymarczyk and Clerk of Commissions D. Rote. <br />ABSENT: Board members; T. Kelly and N. Sergi <br />IL REVIEW AND CORRECTION OF MINUTES: <br />Chairman Maloney advised that the review and correction of June 2, 2005 Board of Zoning <br />Appeals minutes would be addressed after the board addressed correspondence received. <br />Chairman Maloney reviewed that there were 17 cases requesting 29 variances and 2 special <br />permits listed on the docket. He further advised that the board members had viewed the <br />premises involved for each case. He advised that as there were only three members present <br />and three votes are required for approval all applicants present were welcomed to request their <br />case be postponed until the August 4, 2005 meeting. In addition, each case would be judged <br />on the physical situation peculiar to itself, so that in no way is a judgment rendered considered <br />to be a general policy judgment affecting properties and like situations elsewhere. <br />III. BUILDING DEPARTMENT REQUESTS: <br />OLD BUSINESS: <br />Manoi Parikh; 24944 Deerfield Drive: (WRD 2)) <br />Request for variance (1123.12). The proposal consists of an addition. <br />The following variances are requested: <br />• A special permit to add to a non-conforming building (1165.02). Note: The existing rear <br />setback is only 35', code requires 50'. <br />1. A 28 foot variance for a residence too close to rear property line, (code requires 50', <br />applicant shows 22'). <br />Which is in violation of 90-125, Section (1135.08 (A)). Note: Due to a clerical error Board of <br />Zoning Appeals tabled this request on 6/2/05. <br />Mr. Parilch the owners, Mr. Borowske, the contractor, and the following neighbors; Mr. & <br />Mrs. Hogan, Mr. Yanchek, Ms. Bartos, Ms. Wilkinson, each came forward to be sworn in and <br />address the request. Mr. Borowske showed pictures of what would be removed and what the <br />new room would look like to board members and residents. The addition would replace the <br />existing porch. The addition is to be 2 feet deeper and about 2 feet narrower than the existing <br />porch. The room is to serve as a family room and would be fully functional throughout the <br />year. Mr. Kremzar asked if the room would be used as a commercial office. Mr. Parikh said <br />the addition was for a family gathering room only. Mr. Hogan said he would be speaking for <br />the rear neighbors who are concerned about the drainage of the addition. Residents currently <br />have drainage problems from the applicant's runoff and are concerned that if the grading is <br />changed they would have even more water problems.
