therefore, there were not enough members to vote. He apologized to everyone present and
stated the request would be addressed at the August 4; 2005 Board of Zoning Appeals meeting
and notices would be sent out.
4. C& C Realtv; 27932 Lorain Road: (WRD 1)
Request for variance (1123.12). The proposal consists of site development:
The following variances are requested:
l. A use variance for allowing parking & storage of vehicles for a car dealership on
residentially zoned land, (code permits none, applicant shows parking), section (1123.12).
Which is in violation of 90-125, Sections (1123.12), (1139.07) (table). Note: Board of Zoning
Appeals denied variance requests #3, #4, , and granted requests #2, #5, at their
6/2/05. Due to photometric submitted at the 6/2/05 Board of Zoning Appeals meeting
variances #7 & #9 were withdrawn.
Due, to multiple conversations taking place the clerk asked for clarification. Mr. O'Malley
advised that Mr. Farrell requested that his clients use variance issue be tabled until all
members were present and for the board to address his reconsideration request slated at the
end of the docket at this time. Furthermore, if the reconsideration is granted that the
reconsideration be scheduled and addressed in conjunction with the use variance on August 4,
2005. Mr. Farrell stated he was requesting the use variance as well as the written request for
reconsideration both be tabled until the August 4, 2005 meeting. Due to the fact that his client
is at a disadvantage as only three members were present to vote on both issues. He voiced
that the outcome of the issues were detrimental to his client, therefore he would like to address
a full board. Mrs. Diver questioned if there would be something different. Mr. Farrell stated
there would be and as he presented a packet at the start of the meeting to each board member,
he understood that the board would need time to review the packet and absent members
needed to receive the packet. Mr. O'Malley advised that the only issue docketed was the use
variance and the board could grant the tabling of the use variance as a courtesy as there were
only three out of five members present. However, he would advise against tabling the
reconsideration, as it is listed as a communication before the minutes are adopted and a final
order is entered. Mr. Maloney stated the board would table the use variance and asked if the
applicant whished to move the request for reconsideration up the docket to be addressed. Mr.
Farrell answered "yes".
J. Maloney moved to reconsider C& C Realty of 27932 Lorain Road their request for
their variance requests from June 2, 2005 Board of Zoning Appeals meeting numbers #3,
#4, and #6 which were denied be reconsidered. W. Kremzar seconded the motion which
was unanimously approved. During roll call of the motion W. Kremzar stated it was
difficult not having an opportunity to read what was submitted therefore out of a
courtesy to the applicant he would be for the reconsideration. M. Diver concurred with
Mr. Kremzar's comment and hoped the applicant would stick to his word and show the
board something different. Reconsideration Granted
W. Kremzar moved to table C& C Realty of 27932 Lorain Road their request for a use
variance to the August 4, 2005 Board of Zoning Appeals meeting. J. Maloney seconded
the motion which was unanimously approved.
5. B.A.D. Bovs Ltd; 28597 Lorain Road: (WRD 3)
Request for variance (1123.12). The proposal consists of a new development.
The following variances are requested:
4of13
