Mr. O'Malley referenced Planning Director Wenger's memo suggesting the board condition the <br />granting of the variances upon compliance of the area variances. Ms. Wenger is not in favor of <br />retaining the curb cut along Dewey Road as it pertains to the use variance and area variance. He <br />whished for the record to reflect that Board of Zoning Appeals granted variances at their first <br />meeting with the applicant pertaining to Lorain Road setback as well as light pole placement. Sergi moved to grant C& C Realty of 27932 Lorain Road their request for a use variance <br />is granted as follows: 1. A use variance for allowing parking & storage of vehicles for a car <br />dealership on residentially zoned land, (code permits none, applicant shows parking), section <br />(1123.12). This is contingent upon adhering to the ARB and PC restrictions and review <br />which includes no loud speakers, no lights or sales to be conducted on the land. W. Kremzar <br />seconded the motion, which was unanimously denied. "Use Variance Denied" During roll call <br />of the motion: Mrs. Sergi stated that she did not feel the spirit and intent of the code was met. The <br />codes were created to protect against commercial intrusions and she felt the proposal was <br />intruding. Mrs. Diver agreed with Mrs. Sergi. Mr. Kremzar remarked that he agreed with Mrs. <br />Sergi and felt that the amount of noise, and pollutions would be a detriment to the residents of the <br />area. <br />N. Sergi moved to grant C& C Realty of 27932 Lorain Road their request for variance <br />(1123.12), which consists of site development and the following variance, is granted: <br />5 of16
