A 59 square foot variance for total square feet of signage on a building unit #1, (code <br />permits 110 sq', applicant shows 169 sq'), section (1163.24 (C)). <br />Which is in violation of 90-125, Sections (1163.27 (A)) and (1163.27 (C)). <br />Note: #1. Tota1 square footage includes existing wall sign. #2. Applicant advised that property <br />owner/representative must be present at the BZA meeting. <br />Mr. George the Owner, Mr. Reddick, General IVianger West Field Great Northern Shopping <br />center, Mr. Aftoora, with Sign Company, each came forward to be sworn in and add.ress the <br />board. Mr. Aftoora reviewed that the entrance faces Country Club Blvd and only has one <br />entrance. On the opposite side of the ma11 each of the restaurants are noticeable and very well <br />lit by their signs. Currently the restaurant is not visible from Cou.ntry Club Blvd or Great <br />Northern Blvd. Harry Buffalo is the only Resta.urant on the south side of the mall and <br />although the restaurant is open for business after the mall closes everyone assumes that they are, <br />only open during ma11 hours. They-would like to be allowed to place the illumina.ted sign on the <br />east side of the wall. The proposed sign would be smaller ttnan the currrent sign. Mr. George <br />reviewed past restaurants which were once located in tUeir spot and indicated that they are now <br />experiencing what the other tenants felt.and revenues are continuously dropping. They are not a <br />franchise and they are trying to compete with the franchise resta.urants located at the Ma11. He <br />has tried more advertisement and even hired a company fo research why revenues were down <br />and the results of the research showed that the location is not visible and located right next to <br />the dumpster area. Mr. Reddick encouraged the board to help the mall work with Mr. George to <br />try to save his restaurant. Mr. Conway advised that the restaurant was not an anchor store and <br />the commissions ruling should be based on practical difficulty. He further advised that most <br />tenants did not have individual signs or private enlrances. Boa.rd members were not positive <br />the property could yield a reasonable return as there had been past restaurants which failed in <br />the same location. The variance is substantial as code allows only one sign and applicant <br />requests 2. The caricature of the neighborhood would not suffer from the vaaiance. The board <br />did not feel government services would be affected by the request. The board asked the <br />applicant what he would do if a second sign did not improve his revenues. 1VIr. George advised <br />he would have no other choice but to close the restaurant as his other restaurants were <br />supporting the Ma11 location already. The Board believed the applicant required better <br />visibility due to the applicants location. <br />W. Kremzar movesi to grant Harry Buffalo of 470 Great Northern Mall their reques4 for <br />variance (1183.12) which consists of a 2nd wall sign and that the foHowing variances are <br />granted: <br />1. A eariance for a 2°d wall sign on a unit, (code permits 1, applicant shows 2), section <br />(1163.27 (A). <br />2. A 59 square foot variance for total square feet of signage on a building unit #1, (code <br />permits 110 sq', applicant shows 169 sq'), section (1163.24 (C))o <br />Which is in violation of 90-125, Sections (1163.27 (A)) and (1163.27 (C)). J. Ndaloney <br />seconded the motion, roll caU on the motion; J.1VYaloney, W. Kremzar, T. Kelly, N. Sergi, <br />"yes" and M. Diver "no". Variances granted. <br />NEW BUSINESS: <br />1. Douglas & Kathleen Ndaciver; 5806 Stearns Roade OVitD 3) <br />Request for variance (1123.12). The proposal consists of a new shed. <br />The followirig variance is requested: <br />1. A 5 foot.variance for an accessory structure too close to reaz property line, (code requires 10', <br />applicant shows 5'). Which is in violation of Ord. 90=125 section (1135.02 (D4)). <br />4of7
