T. <br />CITY OF NORTH OLMSTED <br />BOARD OF BUILDING CODE APPEALS <br />HELD IN COUNCIL CHAMBERS <br />NOVEMBER 17, 2005 <br />MINUTES <br />I. ROLL CALL: <br />Chairman Puzzitiello called the meeting to order at 5:35 pm. <br />PRESENT: Chairman R. Puzzitiello, Members: D. Sabo, M. Conway, P. Engoglia and N. <br />Althen. <br />ALSO PRESENT: Assistant Law Director B. O'Malley, Building Inspector L. Cifranic, and <br />Clerk of Commissions D. Rote. <br />ABSENT: Member; P. Engoglia. <br />H. REVIEW AND CORRECTION OF 1VIINUTES: <br />R. Puzzitiello moved to approve the Board of Building Code Appeals minutes dated October <br />20, 2005 as written. D. Sabo seconded the motion which was unanimously approved. <br />III. NEW BUSINESS: <br />Target, 24646 Brookpark Road: (WRD 4) <br />Proposal consists of two storage containers being positioned in back of building for the <br />period of November 18, 2005 - January 15, 2006. A variance is requested to allow 2 storage <br />containers visible from the Brookpark Road right-of-way which is in violation of Section <br />(1363.07 (b) (5)). <br />Assistant Law Director O'Malley reviewed that the issue before the commission was not a <br />building issue but in fact a property maintenance issue under section (1363.07 (b 2E)). The <br />owner is asking relief from the property maintenance staridard which does not allow the <br />containers to be visible from the right of way. It is the applicant's burden to show why the <br />code is a hardship and can not be followed. <br />Mr. Stefani, Executive Team Leader for Target came forward to address the request. Mr. <br />Stefani reviewed that due to the holiday season stocking requirements they would require <br />additional storage area. Mr. Puzzitiello questioned what the applicants were going to do to <br />hide the containers from the right of way view. Mr. Stefani did not believe that the <br />containers could be hidden from view. Board members questioned if the containers would <br />block the flow of traffic around the building during an emergency and questioned the size <br />and number of the containers. Mr. Stefani believed that the containers would not hinder the <br />flow of traffic for patrons or the safety forces. Each of the 2 containers is 8-foot tall, 40-feet <br />long and 8-feet wide. The storage containers would be accessed daily between the hours of <br />6:00 & 6:30 am and the containers would be refilled only as needed. Mrs. Sabo questioned if <br />it was Targets intent to have the trailers annually or during any other holiday season. Mr. <br />Stefani suggested that it would be hard to say how often they would need to have storage <br />containers as it was a new store. The board questioned why a new 125,000 square foot <br />building was not large enough to handle holiday storage issues. The additional storage <br />containers would only add about 15,000 square feet of storage and the applicant failed to <br />show a hardship. Board members felt that allowing storage containers would set precedence
