ROLL CALL: <br />Acting Chairman Spalding called the meeting to order at 7:30 p.m. <br />PRESENT: Acting Chairman W. Spalding, Board Members; S. Hoff-Smith, J. Lasko, R. <br />Bohlmann, G. Conaway, and M. Yager. <br />ALSO PRESENT: Asst. Law Director B. O'Malley, Planning Director K. Wenger, City <br />Engineer G. Durbin, Asst. Building Commissioner T. Rymarczyk, and Secretary L. McNabb <br />ABSENT: Chairman R. Koeth IIL REVIEW AND CORRECTION OF MINUTES: <br />W. Spalding moved to approve the September 13, 2005 Planning Commission minutes as <br />written. G. Conaway seconded the motion, which was unanimously approved. <br />IV. COMMUNICATIONS: <br />Request by Council for a Report of Findings pertaining to the Suburban Collision Center's <br />Conditional Use Permit. <br />Mr. O'Malley addressed the Commission regarding the conditional use permit and Council's <br />request to submit formal findings. He summarized the comments of the Planning Commission <br />regarding Suburban Collision as discussed on June 14t' and August 23rd. The Planning <br />Commission found the expert witnesses were credible and offered substantial, probative and <br />reliable evidence to support the findings. Code 1118.03 was addressed and discussed previously <br />and the minutes of the meetings attended reflected that. The major issues were odor and fumes <br />arising from the paint booths. <br />Mr. Spalding advised the audience that the issue would not be reviewed again and further stated <br />that he would be abstaining from the matter as he worked with a representative from Suburban <br />Collision Center. He asked a member of the Commission to take the lead. Mr. Bohlmann <br />reviewed that the applicants presented expert studies and testimony. Mr. Lasko believed that <br />Mr. O'Malley summarized the findings fairly and accurately and agreed the fmdings should be <br />forwarded to Council. <br />R. Bohlmann moved to accept the findings as written. J. Lasko seconded, roll call on the <br />motion. S. Hoff-Smith, R. Bohlmann, G. Conaway, M. Yager, J. Lasko - yes; W. Spalding <br />abstained. Motion passed 5-0. <br />Letter received 9/20/05 from Arlene Pavlovic regarding Arbor Woods <br />A letter from Arlene Pavlovic voicing her concerns pertaining to Arbor Woods was received by <br />the Planning Commission who had previously approved the proposal. Some of her concerns <br />were addressed during the approval of the proposal. However, the Planning Director was asked <br />to follow up with her on unresolved issues. <br />1
