Planning Commission <br />City of North Olmsted, Ohio <br />Planning Commission Findings and Report to Citv Council <br />APPLICANT: SUBURBAN COLLISION CENTER, 26618 BROOKPARK RD. EXT. <br />, Conditional Use Permit Application per 1139.01(d)(1) and 1118.03 <br />A. Findings of Planning Commission <br />The Minutes of June 14 and August 23, 2005, are incorporated by reference and Planning <br />Commission finds that they fully and accurately describe the substance of its review and the <br />basis for its findings in favor of the conditional use.permit application. <br />Upon review of the standards set forth in NOCO 1118.03 (a) through (f), the Planning <br />Commission finds that the Applicant's proposal satisfies each requirement for the issuance of a <br />conditional use permit. Specifically, <br />(a) the proposed use is necessary, is already established at another location, and is not <br />permitted by right in any district; <br />(b) the proposed use is not closer than appropriate to schools, churches, or other <br />places of assembly; <br />(c) the location, extent and intensity of the proposed use is such that its operation <br />will not be objectionable to nearby dwellings by reason of greater noise, smoke, <br />dust, odors, fumes; vibrations or glare than is normal or permitted by the <br />performance standards of the district; <br />(d) the proposed use will form a harmonious part of the district, considering the <br />convenience of access and proximity to the collision center; <br />(e) the proposed use is not permitted in a more restrictive district; <br />(f) the hours of operation and concentration of vehicles in connection with the <br />proposed use is not more hazardous or dangerous than the normal, existing traffic <br />of the district. <br />The Planning Commission finds that the expert witnesses presented by the Applicant were <br />credible and offered substantial, probative and reliable evidence, especially in support of <br />subsection (c) above. Two separate studies were undertaken at the existing facility, which is . <br />comprised of the same paint-booth to be relocated for the proposed use. Both air quality studies <br />confinned the absence of appreciable odor or paint fumes arising from the normal operation of <br />the paint booth. These studies support the Planning Commission findings under subseetion (c). <br />In addition, pursuant to NOCO 1118.04, Planning Commission incorporates and imposes, as an <br />additional.condition of approval, the development plan as presented for review. <br />B. Report to City Council <br />Pursuant to NOCO 1118.05, the Planning Commission hereby forwards the above Conditional <br />Use Application and reports these Findings to City Council for its confirmation.
