w i <br />The applicant has added brick pavers along the right-of-way, but not what landmarks <br />mandated. <br />On March 3`d, the Board of Zoning Appeals considered the variance requests. <br />The applicants were granted the following variances: <br />• Two building setback variances <br />e Illumination level variance <br />• Two sign variances <br />The applicants were denied the following: <br />• Use variance <br />• Parking on the north property line <br />• Lighting distance from residential property line <br />The City received revised site plans on March 7th, taking into account the outcome of the <br />variances denied. However, elevations and photometric plans were not submitted and due to <br />timing of ineetings, plans were not received in time for a thorough review. <br />Building Commissioner Conway reported that the plans dated March 7, 2005 accurately <br />reflected the outcome of the variance requests. The pole lights became a mute issue, as the <br />use variance was denied and the lights would not be moved. The setback which was denied <br />now shows a 20-foot strip of grass. <br />City Engineer Durbin reported that the applicants needed to submit a full set of construction <br />plans. He noted that the majority of the site is commercial and the applicants are required by <br />code to have brick pavers along the entire length of Lorain Road as well as the entire length <br />of the Porter Road tree lawn area. The applicants are required to have a Handicap ramp at <br />the corner of Porter and Lorain sidewalk which is not shown. The Handicap ramp in front of <br />the existing building is required to be brought up to ADA standards. There are a number of <br />other things that will need to be addressed such as storm water, curbs and such. <br />Assistant Law Director O'Malley reported that the Board of Zoning Appeals placed <br />contingencies of the variances that were approved which consisted of the three existing trees <br />along Porter Road to be saved and lot consolidation. He advised that if Planning <br />Commission made any approvals, they include the Board of Zoning Appeals contingencies. <br />Applicants Presentation: Mr. Suhayda believed that the meeting with Landmarks was very successful and after a <br />couple of trade offs a certificate of appropriateness was granted. The existing trees along <br />Porter Road would remain and 3 additional honeylocust trees have been added. Landmarks <br />liked the briclc addition and that the second floor matched the height of the CVS across the <br />street. The Board of Zoning Appeals approved some variances as well as denied a few and <br />the new plans have been adjusted accordingly. There will be no work done along the Dewey <br />Road area, it will remain as is. Along Porter Road the ''setbaclc was adjusted and the existing <br />trees are shown and will remain. A total of S light poles have been removed from the site. <br />Commissioner's Comments: <br />Mr. Koeth asked if the applicants understood that they are required by code to have brick <br />pavers from the corner of Dewey Road to the end of their property line on Porter Road. Mr. <br />Yager advised that the Handicap ramps are also required to meet today's ADA standards. <br />Mr. Durbin advised that there were sidewalk issues which would need to be addressed as <br />, , .. , . , <br />2
