Mr. O'Malley advised that the applicant also proposed mounding with Norway-Spruce trees <br />along the north entrance right-of-way to the site wluch requires landscape replacements wluch <br />also could become a burden to the city in the future. He suggested the upkeep of the entrance <br />right-of way be clearly addressed on the plat as well. <br />J. Lasko moved to approve Arbor Iiomes LLC, PP# 234-23-010 and 234-23-013 of Stearns <br />Road their proposal to create a sub-division by splitting existing parcels as indicated into <br />12 single family parcels fronting along a 60 foot wide cul-de-sac street dedicated to the City <br />of North Olmsted with the following conditions pertaining to the preliminary plat <br />presented: 1). The applicant is to submit the required documentation to the law <br />department pertaining to the creation of the homeowners associations bylaws. 2). The <br />Homeowners Association is to then be called ont an the final plat before final approval. 3). <br />The easements shown on the plans are to not onIy run to the city of North Olmsted but also <br />run to the Iiomeowners Association with respect to the association being responsible for <br />the maintenance and upkeep of the detention basins. 4). The items noted in the City <br />Engineers letter is to be resotved to the City Enginecring Departments satisfaction. 5). As <br />requested by Planning Commission and stated by the applicant they wiii work with the <br />homeowners on the norEh side of Stearns Road at the ingress and egress entrance <br />pertaining to light pollntion as mentioned in earlier discussions. He noted t6at condition <br />(5) was a request not a condition of the applicant's approval. 6). Final plat should state <br />that the entrance right-of-way Iandscapiug areas up-keeping is the responsi6iiity of the <br />homeowners association. M. Yager seconded the motion, roll call on the motion; M. Yager, <br />S. Hoff-Smith, G. Conaway, J. Lasko, W. Spalding "yes" artd R. Bohlmann "no". Motion <br />Passed Mr. Lasko thanked the applicant for working with the city., <br />V. NEW BUSINESS: <br />Dairv Queen Restaurant; 24579 Lorain Road: (WRD 4) <br />Proposal consists of exterior modifications to the existing building including landscaping. <br />Ms. Wenger reported that the proposal consisted of exterior modifications to the existing Dairy <br />Queen at Lorain and Columbia Roads. At the applicant's pre-submission meeting a number of <br />recommendations were made and were incorporated into the plans, including: <br />• Additional landscaping to the queuing island where asphalt currently exists <br />• Additional pavement markings and signage to address the safety of the drive-thru and promote <br />better circulation <br />• The removal of three wall panels/signs on east elevation <br />The following were recommendations not incorpora.ted into the plans: <br />• The removal of the blue neon rope lighting azound the perimeter of the building <br />• Preserving/incorporating existing brick in lieu of EIFS as much as possible <br />• Readdressing parking lot configuration to improve circulation and better comply with code <br />Mrs. Wenger reviewed the Building Commissioners notes with the commission: <br />• The proposed pazking spaces did not comply with the judgment entry of September 6, 1988. <br />• There are 14 parking spaces shown in the southeast portion of the lot, the majority of which are <br />located on residentially zoned property. <br />• Not counting the 14 spa.ces reduces the actual count of the spaces disclosed on the drawing <br />da.ted April 12, 2005, to 250. Calculated at 6 per 1,000, less a 20% storage allowance, they <br />need 275 spaces. There aze also 4 handicap spaces shown which are not compliant with the <br />ADA staudards, and no grades are provided to determine access to the buildings. <br />4
