CITY OF NORTH OLMSTED <br />BOARD OF BUILDING CODE APPEALS <br />IN COUNCIL CHAMBERS <br />JULY 20, 2006 <br />MINUTES <br />1. ROLL CALL: <br />Chair called the meeting to order at 5:35 pm. <br />PRESENT: Members; P. Engoglia, M. Conway and D. Sabo. <br />ALSO PRESENT: Assistant Law Director B. O'Malley, Building Commissioner D. Conway <br />and Clerk of Commissions D. Rote. <br />ABSENT: Members N. Althen & R. Puzzitiello. <br />Chauman Engoglia advised everyone present that due to only having 3 board members present <br />there would need to be a unanimous vote to approve or deny any requests. Therefore each <br />applicant needed to chose whether or not they whish to be postponed or to proceed with their <br />request. Both applicants voiced they whished to proceed with their requestse <br />II. REVIEW AND CORRECTION OF MINUTES: <br />M. Conway moved to approve the Board of Building Code Appeals minutes of June 15, 2006 <br />as written. D. Sabo seconded the motion which was unaYUmously approved. <br />II. OLD BUSINESS: <br />IV. NEW BUSINESS: <br />1. Ciuriano & Carolvn Beredo; 27978 Marquette BLVD: (WRD # 1) <br />Proposal consists of replacing existing fence. <br />The following variance is requested: <br />1. A variance to replace a 70 foot section of fence along an existing fence where a neighbors <br />fence already exists, (Neighbor does not want his fence removed) which is in violation of <br />section (1369.03 (a 3)). <br />Ms. Beredo the owner and Mr. & Mrs. Koehler abutting neighbors each came forward to <br />review the request. Ms. Beredo advised that she wanted replace her existing fence which is <br />over 25 years old with a new board on board fence. The 70 foot section of fence along the east <br />side of her property is needed as there is a white vinyl fence which was constructed after their <br />fence was erected. Mrs. Koehler reviewed that for the past 25 years the two fences have been <br />side by side and they have maintained the area between the fences. Mr. Koehler advised that <br />he has never had a problem maintaining the growth between the two fences. They have no <br />objections to their neighbor replacing their fence. Ms. Beredo asked what code would allow <br />her to do. Mr. Conway advised that code does not allow two fences no matter what the <br />distance is between the two. Mrs. Sabo questioned why both fences were needed as it seemed <br />that the neighbors were friends. Ms. Beredo suggested that her dog could get through the slats <br />of the white vinyl fence and both home owners have dogs they would like to keep apart. The
