CITY OF NORTH OLMSTED <br />BOARD OF BUILDING CODE APPEALS <br />IN COUNCIL CHAIVIBE1zS <br />MAY 18, 2006 <br />MINU'I'ES <br />1. ROLL CALL: <br />Vice Chaiiman P. Engoglia called the meeting to order at 5: 40 pm. <br />PRESENT: Members; P. Engoglia, N. Althen, M. Conway and D. Sabo. <br />ALSO PRESENT: Assistant Law Director B. O'Malley, Building Commissioner D. Conway <br />and Clerlc of Commissions D. Rote. <br />ABESENT: Chairman R. Puzzitiello. <br />• Members need to elect Chairman and Vice Chair for the 2006 calendar vear: <br />M. Conway moved to elect Norman Althen to serve as Vice Chairman for the 2006 calendar <br />year. P. Engoglia seconded the motion which was unanimously approved. <br />M. Conway moved to elect P. Engoglia to serve as Chairman for the 2006 calendar year. D. <br />Sabo seconded the motion which was unanimously approved. <br />II. REVIEW AND CORRECTION OF 1VIINUTES: <br />M. Conway moved to approve the Board of Building Code Appeals minutes dated November <br />17, 2005 as written. N. Althen seconded the motion which was unanimously approved. <br />II. OLD BUSINESS: <br />IV. NEW BUSINESS: <br />Patrick Denham; 28384 Aspen Drive: (WRI) 3) <br />Proposal consists of removing existing chain linlc fence and lceeping existing non-conforming <br />(wood) lattice fence. The following variance is required: <br />1. A variance to be allowed to keep existing non-conforming fence, which is in violation of <br />section: 1369.02. <br />Mr. Denham the owner came forward to address his request. Mr. Denham reviewed that his <br />existing fence is a solid wood 6-foot high fence comprised of 2' x 6' vertical slats every 8-feet <br />along with a 2' x 4' rail along the top and 2-feet off the ground. The lattice is pieced together <br />on either side of sheets of ply-wood and fastened together with stainless steel screws. The <br />fence is well constructed and fastened to chainlink fence rails which he wants-to remove. He <br />has already removed the mesh and once he receives approval he will have a fence company <br />cement posts every 8-feet to support the fence better. Mr. D. Conway advised that the lattice is <br />not an acceptable material, but the applicant could install a board on board fence with a lattice <br />trim along the top for privacy but the existing fence is not allowed. The condition of the fence <br />is poor and he does not believe adding posts is enough to stabilize the fence. Mr. Engoglia <br />advised the applicant that a 6-foot board on board or vinyl fence is allowed but not the existing <br />lattice fence. Mr, Denham reviewed that a fence company would be staining the wood placing <br />the posts and adding a gate later so the fence would loolc better. <br />Mr. O`Malley advised the applicant that he would need to number the photos being presented <br />and when referencing photos indicate which number is being discussed to create an accurate <br />record. Furthermore any future work being suggested is hypothetical and not an issue before <br />the board. Therefore the applicant should present his case based on what is before the board.
